Hi,

I asked this in one of threads but do not get a response, so I am going to ask here.

My wife's I-130 just got approved, so it should be transferred to NVC in the near future.

I am an LPR and in the middle of applying for USC (ETA: Dec 2013).

Let's assume that October bulletin will retrogress thus visa will not be available again.

Will NVC still process the petition (e.g. issuing case number, allowing petitioner to submit DS-3032, I-864 and DS-230, etc) and then hold on to the case (i.e. not forwarding the case to embassy)?

Or, will it stuck/stop sooner than that?

The reason I ask, I need to know whether I need to prepare some of these documents (employment and income statement, etc) now or wait until visa is more available first so some of the documents will not be out of date.

approval at USCIS doesn't mean squat about 'when a visa # is available'.

and it's 'when a visa # is available' , that things go down at NVC.

If you are certain that the casefile is going to NVC and not NRC for storage during the wait, then by all means harrass USCIS to get the casefile over to NVC today.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Ok, I didn't know about NRC storage.

I suppose my wife petition could go to NRC instead of going to NVC directly. I am still waiting for NOA2 letter to arrive.

Does USCIS tell us where they send the petition to after I-130 approval?

Sounds to me if a visa is not available, her petition will not be processed further then.

yup. study the monthly visa bulletin. that's the general announcement for when a visa # is available, for that visa type. However, sometimes the casefile goes faster than what's published in the monthly visa bulletin.
