Gowon the OP hasn't been back on in a bit. They cancelled the CR1/IR1 after the denial. They were denied Feb 2013 and were married in May 2012.

I have heard people say to wait for the NOID or NOIR after being denied at the embassy. We never received either one and waited to hear back. It was almost a year after our I-129f interview when I finally got a letter back from USCIS that our petition had expired. No explanation about why we were denied at the interview, no nothing! Just that we could refile. Luckily, I didn't wait for that letter, as I knew it would expire before I heard back from them. We got married and filed a I-130 about 7 months after getting married. Still waiting on our NOA2.

Hi everybody,

My lawyer told me the same thing he ganna refile my I 130' after that, he will send a letter to USCIS explaining the reason of opening a new I 130 because the marriage wasn't consummated at those dates,he will include that letter with all the evidences?is that make sense?

Yes, that is a valid reason for doing so, but yours is not the same situation as the person who started this topic. Please don't hijack the topics started by others. Your lawyer did this because they know the petition would NOT be reaffirmed.

I have heard people say to wait for the NOID or NOIR after being denied at the embassy. We never received either one and waited to hear back. It was almost a year after our I-129f interview when I finally got a letter back from USCIS that our petition had expired. No explanation about why we were denied at the interview, no nothing! Just that we could refile. Luckily, I didn't wait for that letter, as I knew it would expire before I heard back from them. We got married and filed a I-130 about 7 months after getting married. Still waiting on our NOA2.

That is because you had a I-129 returned, they do not get reaffirmed but expire. I have seen very few from VSC get reaffirmed and

none from CSC in the past years.

The I-130 however will get a NOID/NOIR and a decision to either deny or reaffirm will be made.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Hopefully your lawyer really grilled your husband as to the line of questioning (usually the questioning is targeted at a certain thing) and you submitted evidence that was directed at that.

Going on 4 months the normal wait now is 5 to 8 months just at USCIS then another 2 to 4 months at NVC to interview. At best you have 6 months to interview worst 9 to a year.

Because you have an active petition on file this could very well hose you up greatly.

All you can do is wait it out and see.

You can't compare a 129F to a I-130. Most cases with a I-129F they just say get married. Well I-130 you already are. Very few ever get sent back.

Good morning VJ, After a lot of research on my Visa and the process, I found out my lawyer wasn't up to the task. My first filling was still open which I thought had been closed and I looked it up to find out that they already sent me a letter stating the intent reason they revoked the visa. I and my husband have dealt with every part of it in details and was able to send it back so hopefully they would re affirm it and send it to the consular. In the intent of revoke, A lot of things were different as claimed by my husband. I too was very sad but it was nothing we couldn't handle but this time we made tons of evidence and affidavits included from both friends and family. I found a new lawyer who is very helpful and clarifies things very well. As of now we have two applications on and my previous lawyer said he made it known that we had a pending application which is the initial one we await for them to re affirm but the second one we haven't gotten an approval and I believe from statistics on here is as a result of back log because we filled late April this year.

Does anyone know how long it takes for a case to be re affirmed? Is there any additional advice? God bless you all.

Just as I said you have 2 live petitions. There is no set timeline to re affirm, everyone is different. I have seen 3-4 months and over a year but

I would say the median time is 4-8 months.

What do you mean by the line I bolded ? What was the reason the consulate recommended to revoke ?

What reason do you have to overcome ?

On the intent of revoke it was clearly stated my husband didn't answer certain questions, He didn't go there with a birth certificate, He didn't have so many pictures and lots more. We just had to include a lot of evidence and give them answers in every way we could and I hope this would prove that we have a bona fide relationship. What are the implications of having two petitions on?

A reaffirm takes as long as it takes. I know 4 people currently who just sent back their NOIR's one took 12 days to reaffirm, one took 14 days. One is waiting now 2 months no word the other the same. I have seen some wait over a year.

Now for clarity what petition are you waiting on I-129F or I-130 or what. I am confused on that.
