You REALLY DO WANT to receive a notice of intent to revoke (NOIR) so that you can present more evidence and have the petition approval reaffirmed. It takes less time than starting over and is the proper procedure. Find out if the original petition has actually been withdrawn. Sounds like it hasn't.

Why withdraw, file again and risk to end up in AP again? I understand that it is hard not knowing how long you will be in AP but now you got 8-12 months of waiting anyway before another shot at an interview. And a possible chance of AP again...

I think you might be confused about the acronym MENA. It means a geographic area, not another word for high-fraud. Not sure why the "or" is there.

Because there are high fraud countries outside of the MENA geographical area. High fraud countries and MENA countries need to submit more information because of their location or fraud rate. The "or" was on purpose.

Nigeria is not a MENA country, it is a sub-saharan, but it's about as high fraud as it gets.

It is only suggested when the filers didn't front-load or include some keys things. it is always recommended to front-load at USCIS because that means all your evidence has been approved by USCIS.

I have only known of one case where the evidence filed at NVC was rejected and the couple was accused of trying to sidestep USCIS and enter evidence.

But otherwise its just a 2nd chance to add evidence.

So yes sideload when you didn't front-load is recommended.

Depends on where the country is, really.

Also, it's not a bad idea , if you were scant with the I-130 submittal . Review the I-130 instructions again, go over the 6 types of 'bonafide marriage evidence' there, and you decide whats what.

Gowon the OP hasn't been back on in a bit. They cancelled the CR1/IR1 after the denial. They were denied Feb 2013 and were married in May 2012.

Your attorney was wrong to decide to close out the application unless there is a good reason for it that you did not mention.

If it is just because you thought it would drag out too long then he still should have advised you to wait for the NOID/NOIR, rebut it and when reaffirmed go for the second interview.

Refiling was not the thing to do and wasted time and money.

It doesn't sound like you first case is dead and you will find out shortly what they will decide to do with it.

It sounds like you have 2 live cases currently.

Godswillon72 FYI just to let you know. If your 1st petition is still alive you should go with that because whatever you were denied for they can not deny you again on that petition.

You starting all over again with a new petition they can very well deny you for what they denied you the first time putting you right back in this same situation a year or more from now after your interview.

You need to get on phone soonest and TELL and i mean TELL that lawyer you hired to locate and find your petition and stay with that original petition and answer those issues.

Like Pushbrk said a NOID/NOIR is the best because at least you know what you were denied for and can address it.
