My husband was denied Feb this year in Nigeria and we have been married since march 2012, Reason was the CO said it wasn't a bonafide relationship and didn't state reasons or set up a date afterwards demanding for more paper work and then offered him a 221 g form. We terminated the application because it is time consuming, Now we are waiting for the I-130 form to be approved and its been 3 months and 2 weeks already. Do you advice we file the I- 129f or to wait until the approve it. The application process has rather become very worrying than easy going for my husband to join me here in the United states. Also in such situation do you think there is anything to be done to build up a successful application and hence go through the CO without any problem?

Your husband was denied for what, in December this year?

Don't file the I-129F. It hasn't saved significant time since 2006 and has been virtually unobtainable since 2/1/2010.

He was denied February 2013, The Co was unable to issue a Visa because he failed to convince the relationship was bonafide and the case was going to be pending under 221g after which they were going to contact me. My husband did answer all the questions correctly on about how we had met, Our interest and he said after the Co chatted with another officer... He came back with a printed paper with the above on it. We have cancelled that application and starting all over, I don't know what to do. Being without my husband is heart breaking.

BTW, what you must do is provide ALL THE proof you and your husband have a genuine relationship. He can't just take it to the embassy, you needed to send it with the I-130 then send more with the DS-230. You need to visit each other. Lagos likes facetime. If you've only seen each other once, that's not enough. You NEED to spend time TOGETHER!

We weren't asked to provide more documents and thats the problem. I plan on visiting twice this year and I hope that helps. Like my husband said , The CO asked him questions for about 30mins and came back with that letter. I am just confused.

221g is not a denial, it is Administrative processing. So you were not denied yet but you gave up and withdrew the petition. There is nothing to be gained by doing that — it would have been better to see the process through. So now you just have to start over.

These process are timeless and in some cases you don't know what you are facing. Its so frustrating

If you're prepared, do things correctly, and present the evidence required, most often it is not timeless. Yes AP can be timeless for some people, but those are mostly people from MENA countries, which Nigeria is not. Nigeria is simply high fraud. Many people come to the USA from Nigeria because they do their homework and are meticulous about their paperwork. I suggest reading your regional forum and questioning successful couples from Nigeria about their process.

The most painful part of this application is my husband asked him the reason for being denied as nothing was stated on the paper, The CO said nothing... What must we do?

Hello Godswillon73, please can you clarify something ? Were you asked to submit more evidence/paperwork in Feb 2013 ?

Even if it was denied straight out, then you would have had a chance to send a rebuttal to their claims and keep the petition alive, possibly resulting in a second interview and subsequent approval.

What advice do you want? You need to start over because you withdrew the petition.
