Dear members..

I want to ask about statement "You must marry your U.S. citizen fiancé(e) within 90 days of your entry into the United States". Is that mean must be married within 90 days only or 90 days through file AOS?

For example i will be married in 70 days from i entry to US and Is it ok i file AOS more than 90 days after the wedding? and what is the next step after the marriage?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

u must marry to ur US-Fiance/fiancee within 90 days, after ur entry to US, so those 90 days are for to get married n then u may file ur AOS, suppose lets say u get marry after 20 days of ur entry to US, then after getting ur marriage certificate u r eligible to apply for AOS.

you are out of status after the 90 days, and technically can be deported. Realistically, this is extremely unlikely to happen. Keep in mind that without filing AOS you cannot work or leave the country, which may be an issue if there is a sudden emergency back home.

you are out of status after the 90 days, and technically can be deported. Realistically, this is extremely unlikely to happen. Keep in mind that without filing AOS you cannot work or leave the country, which may be an issue if there is a sudden emergency back home.

I mean we get married in 60 days from i entry to the US, but we file AOS more in 60 days from my wedding date. am i still legal in US?

and should i proccess SSN 2 weeks after i entry to US?

Yes you can file for SN even without being married.

90 days after you enter the USA, you will be out of status if not filing AOS.

Yes you can file for SN even without being married.

90 days after you enter the USA, you will be out of status if not filing AOS.

Can I ask why you want to wait?

we will file AOS after married, but we won't file within a month after the marriage.

If you marry within the 90 days of entry with a K-1, then you are eligible to file for AOS. There is no deadline to file. You will be out of status when the I-94 expires but once you file for AOS, you enter a new period of authorized stay. If you are nowhere near the southern border check points or any CBP or ICE agents while out of status before filing the AOS, then you are more than likely to never have any issues at all with your I-94 being expired. It is certainly not an issue with filing for AOS.

Customs and Border Protection and US Immigration and Customs Enforcement.

You have to get the SSN before the I-94 expires or you would have to wait for your EAD or green card to get one. It is best to get the SSN in the name on your passport and K-1 visa, then change it later to your married name. Guide for SSN > http://www.visajourney.com/content/ssn

File as soon as you can, Jay-Kay is correct, lucky you don't live in a border state. The process is slow so file when you can, don't forget to apply for your EAD and AP (free with the I485). Pay attention to the guides. As T-Bone has said:
