I-130 F2A just approved by USCIS what to do to to speed up???

There's nothing you can do to speed things up as we all go thru the National Visa Center (NVC).

Anyway, the PD will retrogress this coming Oct VB so you'll have to wait until your priority date actually becomes current again.

Well I can contact NVC and tell them the priority date is current and the child will age out . And I thought if the priority date is current when petition is approved by USCIS we are good . According to you we aren't ? :-(

Yeah, sadly.

I was approved June 14, 2013 and I'm still not done with NVC. You can refer to my signature.

CSPA will come into play when your PD becomes current.

Gather the beneficiary's DS230 and civil documents AND prepare the Affidavit of Support forms NOW so it'll be ready by the time NVC asks for it. Great time saver.

Lets clarify this and get you the right answer.

As long as the DS-230 is filed while the PD is current, then the 20 years old age will be locked in.

Retrogression will NOT AFFECT ANYTHING. Even if the PD regress and the child's age is over 21, CSPA will keep the child's age under 21 as long as the DS-230 was filed when the PD was current.

Age freezing is determined when the PD became current. If the DS-230 is filed on Sep. 30, CSPA age is frozen on Aug 1, 2013 because the OP's PD is before that date.

CSPA will not kick in until a DS-230 is filed. No DS-230 while the P is current, then no CSPA protection.

The most important thing is to file the DS-230 before the PD is anticipated to retrogress on Oct 1.

Once your brother files the DS-230, his CSPA age will freeze at 20.
