Hello all.

Thanks for your help, as always.

I have a question regarding this issue. My fiance and I want to get married in the foregn country for it to be recorded for local purposes here. Is it possible to have the marriage recorded in a foreign country after obtaining the K1 visa and still have no problem arriving in the US?

Thanks

You must not enter the US on a K1 visa already married. It'll void your K1. If you want to get a second marriage for some reason, do it *after* you've done AOS or have your AP.

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* How? Read my DCF London I-130 for CR1/IR1 Spouse Guide

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

If it is considered a legal marriage no, you cannot do it first. The purpose of the K-1 visa is to permit the intending immigrant to come to the US to marry inside the US. If you are already married you cannot come on a fiance visa. You might be able to come here, marry, then marry in a Muslim ceremony and have it recorded in his country. Check with the embassy of Pakistan for further information (that is where in the US you would have your Iranian affairs handled).

I've looked into this issue too, as my fiancé is Iranian also. You just need to obtain a Muslim certificate of marriage here in the US, which I understand isn't difficult to do at all. That way your marriage will be legally-recognized in Iran and you can travel their legally as husband and wife.

If you enter the US as a married person on a K-1 you will be banned for life when they find out, even if you area USC by then. Yes, it has happened.

If you want to get married abroad, K-1 isn't for you.

Or, you can wait until after you have your GC and go back and have a wedding ceremony.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

They are correct, if you want to get married abroad do so and file as such, a k-1 is for unmarried entry into the US.. Their are no shortcuts in this game especially if you are from the middle east. http://www.visajourney.com/content/guides Also see the Iran Forum.

In Arizona its hot hot hot.
