Does it take faster to get your case processed when you return the checklist or is it the same 20 days nonsense :'( - any experiences? I got a checklist for the AOS that I didn't submit an explanation for not filing taxes for 2012 when I did send them an explanation in writing.

They told me just send that explanation back again, they can't do anything else for me.

Actually I did exactly that - I called 3 times - 3rd time the guy was nice, I explained to him the situation - he said ok he will tag it for supervisor review and that it would again take 20 business days. In the meantime he said I should just send in the cover sheet again with the document that I had sent them already just to be safe.

Is this enough or should I actually request to speak to a supervisor who can perhaps clear this issue right away?

i would call again and talk to a supervisor. alot of times its the person on the other end who's having a bad day. being nice on the phone can sometime help alot.

Let me explain what happened in my case. Basically since I'm a medical student I didn't have any income for 2012. I am using a joint sponsor and his income is sufficient to meet the requirements.

Now since I didn't have any income for 2012 I did not file a federal income tax return at the time that I sent in the form. I did file one for 2010 and 2011 b/c I had a few hundred bucks worth of income in those years. So I sent them an explanation letter indicating why I had no income and why I did not submit a federal income tax return for 2012.

Now after I sent the AOS package in, someone advised me to just submit a 2012 federal income tax return for the heck of it even if my income was $0.00 in case someone asks for it in the future, so I did that.

Now I am caught in a catch 22, should I send this new tax return transcript to them? Its going to take the same 4 weeks to process I suppose. Or should I just insist on the phone to a supervisor who can look at my documents and just make a decision right then and there.

Confused - any advice?

I called them again - requested a Supervisor, one wasn't available so they took my number and said one would call me back within 24 hours.

Lets hope they do and I'll explain my whole situation to them and hopefully then they will just process my AOS to completion - keeping my fingers crossed!

doesn't make sense, don't these people even read the package contents properly!

checklists are taking about three weeks for review these days.

Just because you haven't earned money, it does not remove your obligation to file taxes.. but I am sure you know that already.

call nvc, get a supervisor on the phone and explain your situation.. hopefully you will get gus on the phone.

Thanks stevie, however i believe i read on several threads here if you make below the threshold( i had none) income for the tax year and put in a letter explaining why you did not file taxes its enough.i have no earnings, income whatsoever since till undergrad i was in school full time and after that married and moved abroad as homemaker.

yes you are correct in terms of the letter and the guides here on vj. if you were to ask someone at the IRS, they will tell you differently.

if you email to nvc, it could take some time.. a week or three. I would call and try to get a supervisor on the phone.. much faster.

if you email to nvc, it could take some time.. a week or three. I would call and try to get a supervisor on the phone.. much faster.

i called NVC today and the lady checked with her supervisor, it seems i might have made a small mistake actually.

i did mention unemployed in part 6, question 4, and also stated my annual income was 0$ in question 10 part 6.

however she said part 6, question 13. a b c i should list the amount as 0$ and write 2012 tax year.

i thought this was only to be filled if one had filed taxes, so unfortunate - another 20 days gone ...
