how long after wedding do i have to file AOS

Hello,

does anyone know for sure if there is a time limit to file the AOS?

I have a K1 and only have given the information to file it ASAP.

Hope not to head into trouble since it has been a year in my case.

As a K1 as long as you were married within the 90 days you should be ok. However on saying that, since you have already waited a year you should file it pretty soon. I dont think that you will get into trouble since you satisfied the visa by marrying within the timeframe (if you did) If you did not marry within the 90 days that could turn into a problem depending on how long ago.

Other than that, just file ASAP. It is better to have it all over and done with and know where you are legally.

Yes we got married within 90days.

Just that I heard now that it has to be filed within 6 month and that I am illegal now.

This shocked me , but I think if there is a time limit, they would tell You in the papers.

Like the medical expires after one Year for example.

I never found any time limit on any form.

Most do it as soon as they have a copy of the marriage certificate in hand, why have you taken so long?

Well, we had some financial nightmares to get through

your not actually illegal since you have satisfied the condition of your K1 visa and entered the country legally. .. You are out of status.

Hopefully you will be able to file soon and get the ball rolling on becoming a LPR! Read the guides on here and also read about 5 pages of threads... should answer just about any question!

we waited 13 months to file with no problems, I would recommend filing for AP and EAD at the same time. Annie is having some issues with not having a state ID and the only way to get that is to have a GC or EAD. IMHO

Cna I ask why you waited so long to file? Didn't you want EAD/AP? Why not get the process started?

I make enough that Annie does not need to work (she is a writer), we did not realize the effects this would have. We were thinking we would wait and avoid the whole conditional LPR. The longer we waited, the more we realized we made a mistake and should of applied for it all as soon as possible. Especially here in CA where we need those documents to get Annie a license to drive. And the fact that survival here with out a license is difficult.

So we have eaten our humble pie and start those processes. If we are still in name check limbo in January, we will file EAD, primarily to obtain the documentation needed for Annie to acquire a Drivers License.

Please everyone, learn from our mistake. Apply for it all, as soon as possible.

You need to file for adjustment of status now. The Calif. DMV will not even issue an identification card without verification from the USCIS. It took my wife four months to get her CA Id card and she received her green card back in May. It came in the mail on Saturday. She is now beginning to get a desire to learn to drive. We had one lesson last December in which the car ended up over the curb and in front of an office building. She's been a little reluctant to try again. But, you are so right about the need to drive in CA.

Most everyone wants to get their spouse a green card pretty soon to get the process finished and have the freedom to come and go from America as we wish. I'd suggest you try to get this finished before Christmas so that you can deal with the aspects of AOS in the new year.

Yes, we are also in CA and just moved into an area where I can get to places by bicycle. Before I was totally depending on being driven around.

I am so glad to hear from John and Annie that there was no problem to file this late from the INS.

This was my biggest concern. We just didnt have the money all the time. My husband is selfemployed and the business is so bad since I came here. Now we need to do the taxes for the Affidavit, cause we are behind and we decided not to get the Tax-guy, but do it ourselfs.

Yes, and I said that we should have at least a stamp from 2006 on our file, so it is not heading into two years later.
