Please take a moment and help me with the questions I have. Thank you!

This is on behalf of a green card holder who is trying to bring an adopted child to the US and wanted to keep her here as PR. The petitioner just arrived to US 6 moths ago as permanent resident (family base visa) . The child is 16 years old (adopted when she was 1 or 2). The concerns is;

= Petitioner is from a very poor country in Africa - when they adopted the child there was NO paper or legal document exchanged between the biological parents and the petitioner, Simply since the petitioner could afford asked the parents and they hand her over (sounds strange but this happens). There is/was always wars/instability in that country and since a long time there is no contact between the two parties . The petitioner don't even know whether the biological parents are alive or not . How to prove or provide the required document as stated on USCIS webpage?

  • Copy of child’s original birth certificate
  • Copy of the final adoption decree
  • Evidence that you had 2 years of legal custody (this could have been awarded by a court prior to the final adoption decree)
  • Evidence that you had 2 years of physical custody (this means time during which the child was living with you and you were exercising primary parental control)

Your friend may have a hard time. Becuase the US has a hard stance on child trafficking if will be on your friend to prove they have proper control on the child, They may have to locate the bio parents or go through formal court activities there to have the child legally declared to be adopted legally by your friend. Without legal papers there is little hope of the child coming

This will not be over quickly. You will not enjoy this.

This is a great idea and it should be done as uscis requires . The adopted parents went to a court and asked to be granted such a document saying yes this child is in legal custody, they've been turned down saying we don't have such a procedure for citizen, unless we have a record of the child is being reported missing which in this case not. Yes if a foreigner want to adopt they have to go through court. How about if they can get a school - a religious organization where they live and a few friends and neighbors writing that yes this child is being living with such and such people - would this help?
