Another question Darnell, if I am asked on whether I am married or not I would say "I am married" right? What should I do if they would say that I cannot apply for SSN since I got married and have to wait for my GC before applying again? I just read a post that had the same problem.

Alas, the problem lies in the knowledge , or lack thereof, of the slow-brained sub-humans working in the SSA offices.

A k-1 visa holder, regardless of marital status, is allowed to apply for, and get, a SSN, whilst in the middle of their authorized stay.

If you get such a brain-dead human, ask for the supervisor. If the supervisor is also brain dead, go to a different SSA office.

I entered the US on a K1 visa and my I-94 expires on September 26,2013. We got married without applying for SSN and now I would want to apply for my SSN with my married name. I understand that what most people do is apply for SSN using the maiden name then get married and then go back for a name change. Is there a different process that I have to go through or any different requirement?

My wife applied for her SSN in her married name right after we got married.

We hand carried our marriage certificate to be recorded and requested certified copies right there (you may not be able to do this in your area- don't know). Then we took the SS-5 and certified copies of our marriage certificate to SSA and my wife got her SS card in her married name.

There is no reason to wait.

WE got her SSN as soon as she entered.. but after married we missed the two week deadline for name change..

we got told to wait till green card came in..

well, she got her EMPLOYMENT AUTHORIZATION CARD>. and she went to SS Office and they gave her a new card to show she would work AND changed the name..

once green card comes in.. then she will get another SS card.. WITHOUT the endorsement..

so it don't really matter.. :)

The SSA is a federal agency so the rules are not different in every states. The problem is more about how competent is the SSA employee you deal with.

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

I applied with my married name and did not have any problems, but like others said it's different in every state.

Social Security is a federal program and it's the same in every state. The problem is that some SSA employees are not properly trained.

Just went in the SSA office yesterday with my husband and tried to get an SSN with my married name (we already have certified copies of our Marraige Certificate, married just 2 days ago, August 19th!).

SSA person didn't allow me to use my married name. sSo yeah, It differs in every state. She said it has to be the same one like in my I-94 printout. She also said to just come back after my 'status' has changed with the INS. I asked her which forms should I bring in for a name change, she just repeated herself: Just come back when you have your status changed.

In my mind, she's talking about AoS and the EAD card but she doesn't know EXACTLY which one she wants me to bring in for a name change. (Even if I told her about AoS and EAD.)

Anyhow, She found my name and verified it. Arrived in the US on August 8th, Married on the 19th, Applied for SSN on the 20th (just a day short of the prescribed 2-week mark). The card will be delivered shortly, she said in about 10 days. :)

cool. go back tomorrow, same office, ask for the SSN (the number, not the card).

if no problems, you'll get a printout showing the number. .

if problems, well, sorry, but you'll learn of them right then, and right there.

I would say it differs for each SSA employees you deal with. Another SSA office in the same state would have maybe given you a SSN with your married name... even maybe just another employee in the same office!

Anyway, good that it was smooth! You should be able to go back with your EAD or Green card, whichever comes first, to update your name later.

Ya know - I'm gonna follow you - each time you write this stuff.

Why? It's #######. You're giving false hope to folk , leading them to believe that what worked for your wife will work for all.

It's not that way, at all.

You got exceptionally lucky. USUALLY, when folk apply in the married name (K-1 visa holders) within the 90 days on the I-94, a properly trained SSA staffer will send the stuff out for DHS Verification.

That was skipped, with you and yer wife.

I hope you realize how exceptionally lucky you were. I also hope that you stop repeating 'your story' as the gospel.

It's not the gospel. It doesn't work (mostly). You and your wife were exceptionally lucky, IMO bullying a SSA staffer to make it happen without the SAVE db lookup.

I ask you stop repeating your story, as it's not the way it's supposed to be done at any SSA office.
