So im back again i just spoke to a good source who works through the london embassy

i told him my story of my caution for cimt that i have (theft of a traffic cone) and accidental misuse of the vwp <<<<< forgot about the crime as it was so petty and went to america on it and he said no question im to be denied my visa and i will have to do the waiver

he also said it will be hard to overcome as 83% of people are denied for a cimt

they will look at it as a vile act i committed even though it was not it was a practical joke gone wrong

he said my story wont hold up and have any use during the interview

i knew my feelings was it would be this way

but i want to say thanks for everyone with kind words and the help

il be back soon no doubt with questions about the dreaded waiver

she would not be able to live here with having to care for her mum and help pay the mortgage thats why she needs me there

i guess it will have to be a long distance relationship for good it would be so hard for her to be here impossible infact

to be honest i dont think there is a solution

i hear from people its just a caution not a conviction

the fact is on the subject access report it says theft

it really was just a traffic cone

and no matter what anyone says its a denial and will get held up for missrep on the vwp cause i forgot about this as it was so petty

its a heart break and with a cimt and missrep its so hard to get over and get a waiver approved even with a good lawyer

im at breaking point

I hate even commenting here because of all the negative energy you insist on creating over and over in posts. You are working so hard to defeat yourself, even telling someone at the embassy your details to further insure everybody knows you shouldn't get a visa instead of letting the officer figure it out.

My fiance went to his interview today in London and we were convinced he would be denied. We've been preparing for it for 2 months since we learned he had a crime of moral turpitude on his record from 17 years ago. We've almost finished preparing the 601 waiver and I was making plans to visit him in August. So he calls me this morning and says "I'm sorry darling, you won't be spending this winter in Wales. I'l be with you in America!" We were both crying by that time and I still can't believe its true!

Apparently the crime was moral turpitude, but of a minor nature and they allow you one conviction. We knew about this exception, but thought the other three offences (all minor traffic violations) that all happened at the same time 17 years ago would negate the forgiveness clause. Apparently not! The CO said "you're approved" and Graeme was in shock. She had to keep telling him he could come to the US without a problem. The whole thing is so surreal and still hasn't completely sunk in yet.

For all of you who are still waiting, don't give up and good luck!!!

That is one out of hundreds that luckily got through plus he never used the vwp so there was no accidental missrep

so the exception rule came in i see loads who would come under the exception rule but get caught with missrep and thats me

even though mine was so minor and was just a cone is besides the point

its classed as theft they will see that deny me for a cimt and missrep i think that is pretty obvious

so im preparing myself

i guess nobody will know how you feel unless they have gone through it

yeah we have they said the same thing i am saying even though its just a caution and i come under the petty exception rule it was the misuse all be it accidental that will deny us

just frustrating as its honest mistakes and im not a criminal it wasnt a criminal act

but cautioned for something over nothing

I really your stressing yourself out for no reason. People get to america with worse crimes. A traffic cone is does not come under that categories. If you have to sign a waiver so be it. Really stop stressing yourself you will end up in hospital then what good would you be to your fiance. Take it one step at a time. Get the waiver ready incase you need it. Dude, you need to stop beating yourself up and making yourself miserable over this. You took a traffic cone, and got essentially what amounts to a ticket. And you inadvertently filled out something incorrectly on a VWP form. You didn't steal a car or murder someone. Based on your timeline, you have your NOA2 and will likely have your interview in the next couple of months, and you are going to drive yourself nuts if you keep worrying about this. My advice is prepare what you need to prepare for your interview, and when you get to the interview, should any of your past come up, be truthful. But seriously, if you keep worrying about being denied and acting like you're guilty of a heinous crime (which you're not), your denial will be a self-fulfilling prophecy. Refocus your efforts on preparing yourself for your interview.
