I am starting this thread - for a couple of reason:

One to track the progress of my application.

Avoid errors by gaining insight from other knowledgeable / experienced people at this web page.

My situation.

I have a Honduran wife and stepdaughter. I lived in Honduras with my wife for several years. We were married in 2009. Together we parented another little girl in 2011. In 2012 for financial reasons I had to come back to the USA to work until I could take care of our financial challenges. (that is another book all by itself)

I have been back here and working since the very beginning of the 2012 year, while I was in Honduras I only worked on our farm and had very little or NO INCOME to speak of. When I returned I learned that my petition for my wife and her daughter would require verifiable income- and I had none for at least 4 years previously.

I attempted to apply for a tourist visa on two occasions and we were rejected two times. In the meantime we filed a consular report of birth and successfully obtained a USA passport for our daughter. She is a US Citizen by birth, I guess these were even more reasons WHY they rejected our "TOURIST" application - and they failed to believe us when I said my wife just wanted to VISIT - after all if ahe is not at our farm things will rapidly deteriorate. All along the officers at the embassy encouraged us to fill out the I130 petition for family member and so that is what I have done.

I am mailing in the application TODAY. it is complete-- and this is what the package includes-

TWO CHECKS $420 each one for my wife and one for my stepdaughter.

i am also sending a form G1145 so I get electronic notifications from them-

i am sending to the CHICAGO LOCKBOX office and we have a local office in NASHVILLE that is only for support- - not a full blown office - I guess the closest office would be in Louisville KY

Thanks for listening-- would LOVE any advice and or comments- -- I am expecting this to take 4- 8 months- in total. (optimistic at this point)

WHAT A VALUABLE WEBSITE-- I already learned some things just browsing- I HOPE somone with experience can comment on my application I do have some questions--

I AM ADDING a certification of the translated pages-- Will include those with the application---

MY WIFE was never previously married but had asked a missionary to list himself on her daughters birth certificate ( my stepdaughter)-- my only concern is my stepdaughter - not to get too personal but my wife NEVER had a relationship with the natural father- he has NEVER even met his daughter - -- but after she was born became friends with this missionary family ( who was a married amercan and he claimed to be the father -- thinking it would help)-- we still keep in touch with this family although they are no longer spending time in Honduras - they live in Puerto Rico--- What documentation IF ANY should I get to help my stepdaughters application- it is CLEAR that she is the daughter of my wife - and it is clear that we are married-- therefore she is my stepdaughter-- Like I had stated my wife has never been previously married.

Regarding the other items- is giving MORE than enough information in any way a negative?-- or is the KISS method apply ? and lastly- regarding my stepdaughter-- am I not thinking of something or am I overthinking that too?

KISS method, the purpose of your birth certificate or a copy of all pages of your passport establish your US Citizenship, nothing more. Same goes for your stepdaughter.

Do NOT want to be any bother- but I want to make sure I do NOT make any errors- and expedite the process. WE ARE TALKING TWO DAUGHTERS. One is my biological daughter who is not on any petition because we already processed her BIRTH ABROAD as a US CITIZEN - and we already got her passport-- it is my stepdaughter who actually has NO passport as of today but is working on getting her HONDURAN PASSPORT- like her Mother (my wife)-- TWO I130 petitions are being filed ONE for my wife and one for my stepdaughter--- My wife was never previously married- BUT nine years ago listed a good friend and missionary as the father (not biological) -

It is the paperwork on my stepdaughter that has me concerned-- OR is she approved as the daughter of my wife once we establish our marriage and relationship?

Actually not too complicated but has me searching for the "CORRECT" answers BEFORE I am hit with requests for additional paperwork IF ANY. I have time NOW to get what I need if I need to...

make sure you get the correct birth certificate, marriage certificate .. is the ""Forma Literal" this is the rare one that is only text on special paper... very few people in Honduras use this " Forma Literal " and you might get the run around in sps... the special paper is rare and took me over a month to get it printed..

also on your step child the missionary might not be on the " Forma Literal " birth certificate ... that is something to check..

there is a example of " Forma Literal " on the US embassy Honduras website.

I DO HAVE the FORMA LITERAL birth certificate for my biological daughter- it was required for the "Consular Report of Birth Abroad of a US Citizen" (CRBA)- so I am aware of that AND - I know HOW to get them IF they are required-- it did NOT specify that in the instructions for the I130 - and it DOES specify that in the instructions for the CRBA.

so now you got me worried.. I thought I had EVERYTHING covered checked and double and triple checked - -- Even went this morning to the USCIS office here in Nashville Tenn and she told me they do NOT check paperwork at that location - but.... in conversation she looked it over with me and seemed satisfied with what I had...

This is what I "LOVE" about this process-- always a grey area... room for interpretation...

EITHER WAY- it is GONE -- SENT OUT today and I have mixed emotions - so HAPPY to have checked off ONE MORE thing to do- BUt at the same time had been working so hard on the paperwork and for so long -- getting it perfect... I miss my paperwork-- feels like I have nothing to do now... except wait- for the next check box---

It does seem to me this should be easier than it is-- a while back I spoke to an attorney who quoted me $7,500.00 to handle it for me.-- to me this is an ABSOLUTE REDICULOUS amount of money to ask for and question WHY LAWYERS MAKE LAWS SO COMPLICATED? but I digress.

8-16-2013 my journey officially begins... I am hoping and praying for a smooth journey. I am happy I found this website and do spend time reading other posts and experiences.

they are required... all you had to do is search in this website and see how many people did not get that and caused a delay... why did you ask for advice then send it anyway?

Caps = shouting..... so in the time you wrote your response to me about how I'm wrong you could have done a search and found out that it IS required...

But I can assure you with near 100% certainty you will get a checklist with the missing documents

Birth Certificates

All Honduran birth certificates must be originals issued by the "Registro Nacional de las Personas" (civil registry) in the long format known as the "forma literal." See sample of Birth Certificate (PDF 288KB).

I would suggest getting them now so when you do get the checklist you can send them asap...

Mr Irwin,

You are absolutely right-- in addition to putting POSTS on this website- I took the paperwork down to the USCIS office (Nashville)- and showed it to a woman working there-- After I showed her the paperwork I thought it was OK-- so I sent it ---

I was and I am anxious to get the process started- I will start working on the literal forms just in case ( or when ) they ask for them- hopefully it wont add too much time--

BENEFIT - of having this website-- to Plan ahead

even when I was processing the Consular Report of Birth of biological daughter they accepted my marriage certificate- in its current form--

SEEMS to me that this DOES NOT have to be this difficult- but even when the woman saw my daughters Report of Birth abroad- she said- OH!, this is what the new ones look like- and further went on to comment that it looked HARDER TO PHONY up and said they had lots of fraud with them in the past-- I guess looking at things from THE OTHER SIDE- NOT EVERYONE has the same moral standards - and need to be checked and rechecked- sad thought.

Will the "FORMA LITERAL" be required by USCIS, or will the STATE DEPARTMENT request that?

either way- I am working on getting them BEFORE being asked for them, my MArriage certificate and stepdaughters birth certificate we have to go to SPS for, my wifes birth certificate we have to go to YORO for that--

we have mother in law and aunt working on them as we speak--

I still have not been notified if the applications were accepted they were delivered on 8/19 am.

I attached a G1145 form-- what should be next? and how long is normal?

Give it about one week to two weeks to get the notification.

USCIS tells you to wait 30 to 60days to get the notification BUT you normally receive it sooner.

I also thought the documents you put together looked good!

So, planning ahead- with admitted OBSESSION over this process- these are not statements but questions making sure that I am understanding the process to come - so I may prepare--

I am soon expecting a NOA - or a notice of acceptance (1)--

at which time I understand they MAY ask for evidence (RFE)- or they may forward it on to the NVC (national Visa center to be processed) which would be the second NOA (notice of action)

Once the National Visa center (NVC) has the package they will contact me and ask for MORE DETAILED DOCUMENTATION - including forms:

Form OF169-- Instructions for immigrant applicants- which more or less is a checklist that needs to be signed-- and sent in with ALL documentation-- I am assuming that would be filled out in my wifes name and only one copy is required- minor children do not need one?

Form OF-230-- part one and two' Part one being Biographic data, and part two being a sworn statement- AND I am ssuming that one of these has to be filled out for everyone? including the petitioner and the benficiary and all minor children?

Form I-864 -- Or affidavit of support-

at which time also need copy of all birth certificates and marriage certificates and divorce decrees (long form)--

Is that correct? am I missing anything? -- I want to have this stuff WAITING for when I receive the NOA.
