Social Security Number

Hello guys I'm Liz and I just married my husband last July 20, 2013. I got here last second week of May through K1 visa and my visa will be expired on Aug 19th.

I never filed for my Social Security Number beforehand since we thought we can file it after we got our original copy of our marriage certificate. So we went to the Social Security office last Thursday 8th of August to file for my number. Now the office called me today saying they can't process my number because I should have processed it on or before the 5th of August. In order for me to get my SSN, the lady on the phone told me to have my visa renewed or get my green card. We are about to send my Adjustment of Status application but I'm so worried about the SSN.

Here are some of my concerns:

When can I apply for my security number?

Am I still legal living here in US without that number?

I want to drive and get my license but without it, I don't think I can.

I want to work too, but how long would it take me to get my conditional green card so I can process my SSN?

I am sincerely asking for all your help. Please enlighten me. Thank you for having time reading my post.

-Liz

It's now too late for you to apply for a social security number based on your K-1 status; you need at least 14 days of validity left on your I-94 in order to do this and now it is beyond that time-frame.

You will instead need either your EAD or your green card in order to obtain a social security number. Not having one is not especially important at this stage of the game.

When can I apply for my security number?

i have my ssn before i got married and then went back to change my family name to my husbands family name but they said that their system would state im out of status..the USCIS should be informed first if you are married to a USC..maybe u can get ur SSN if you have your EAD.SSN is very important such as you can be under your husband's insurance, joint acct, credit cards etc.

Am I still legal living here in US without that number?

you are out of status but if you will file AOS u will be fine..just done go near on the US boarders.

I want to drive and get my license but without it, I don't think I can.

It depends on every state. Some state will allow u to use your driver's license in the Phils for the meantime but some state are strict..they will give u a driver's license if you have your GC already.

I want to work too, but how long would it take me to get my conditional green card so I can process my SSN?

everyone who comes here mostly want to work ang get the GC but usually it takes 3-5months before you will get ur SSN( if you are one of the beneficiary who have their AOS interview) but if your case will be transfer in California it means u are one of the beneficiary who will skip having AOS interview, that means you have to wait within 2 yrs to get GC.

Hi Liz. Sorry.

Can apply for SSN again when you have EAD or Greencard in hand.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
