Is there anyone still out there whose I-130 is still not approved? This is just difficult. I have written to local senator for help but I don't know what else I can do. My PD date is 25 Feb 2013 but now I am also US citizen and have notified USCIS accordingly. The status they gave me is my case is under 'additional review'..well they had 1 year to do that and that was not enough? Can I sue USCIS?

Dear Okemo, you are not alone here. My PD is June 28th. i've contacted USCIS twice with the special requests due to the exceeding of the normal processing time. I got one response in December from Nebraska stating that my case needs additional review. I contacted them again on February 11th noting that I am ready to provide any additional information. No reply yet. And I am going to contact them once again next week.

You know we have nothing to hide and are willing to cooperate. I know how frustrating it is to be suspended like that. Moreover, our case is pretty straightforward and what is most important our marriage is true and we miss each other enormously. On top of all the legal documents showing our bona fide marriage, the variety of pictures for the last four years of our relationship that I've shared with the USCIS add obvious weight to our case. Frankly speaking, I am a bit disoriented and I am wondering what is the right way to deal with the USCIS so they act effectively, at least within the established timeframe.

I want to share with you that my husband and I are more on a creative part, we support each other in various ways, and we view this distance as a chance to explore each other more deeply had we not had this experience. But there is time to everything. We as a couple don't see any point in being far away from each other for the second year. I have no idea what Nebraska sees and how anyone benefits from this ridiculous waiting with no response from their part. We pray and believe that we'll be together soon. Although I ask myself each day what else can I do to make USCIS take care of our case. Some suggest contacting their representatives, some state it's useless.

Okemo, being a lawyer myself I don't see any point in suing them. First of all it's going to take more time, money and efforts with null result most of the times. In your case you should highlight that you are a US citizen already wchich gives you much more benefits than just being a resident. I think we should contact them as frequent as possible, use all the available options, like reaching the representatives who really care about immigration cases and don't let this experience take over the beauty of family. I wish you strength and I pray that our cases are completed soon

Sorry to hear Summery Eyes that you are stuck too and yet there is slight conform that at least I am not all alone. Lets keep each other posted and I wish you good luck but I am not sure if contacting them over and over will help either. We are fighting a really really bad policy and I don't think we can't do anything other than perhaps contacting congressmen. This is also the reason why I think if we all come together maybe we can fight this off with lawsuit and fix it.

My wife have had two miscarriages during this time both within 2 weeks of me leaving her back. Stress of being apart is obviously a factor. The USCIS policies are inhumane and make no sense.

They are trying to fool people with background/name check taking months even years. I don't understand, I am software engineer and in todays electronic age it takes seconds to get all the data. Give them time to analyze it, and 2 months should be more than plenty. Anything more than than is either extreme lousiness and statement that they don't care. I-130 approval is not something that our spouses will here the next day. There is a lot of processing still left so why hold everything for the clearly flawed background check.

This is extremely frustrating. I am thinking of moving my Job outside US to be with my wife but it's a tough for many reasons. Finding job in another country is never easy either and the uncertainty of what if I just moved and case got approved.

Vivian&Jaba, thank you for the useful information. At least, it gives some more or less clear image of statistical data.

Okemo, I am really sorry and feel deep empathy for what you and your wife have gone through. Immune system is prone to stress and it's absolutely anti human what you've experienced. As you can see I am from Ukraine and we've just suffered a lot of human losses overthrowing criminal regime, and now we are on the brink of war with Russia. It may be life threatening to live in Ukraine for young active men who can be brutally involved in Putin war. And as a wife I am worried about safety of my husband. Still, I am not losing my hope and optimism. My philosophy is that everything comes in good time. My guess is that calling USCIS, contacting your representative, petitioning and driving attention to our cases are the best tools to expedite the case. Once again, court proceedings, esp, against federal agencies, are slow and cumbersome. If you feel that your case is strong, you have a lot of patience and determination, then a good litigation lawyer may help. With all due respect and taking aside emotional frustration, objectively I don't see how our cases are not in line with the general way of immigration proceeding in this country. I agree that the beaurocratic system is outdated, sporadic (some move fast some move slow) and ineffective, and in our Internet age it takes minutes to get all the necessary background checks. Still, we have to understand that we are in the country with huge percentage of anti immigration proponents, who are building their whole political careers on resistance to immigration. Don't let this ineffeciency interfere with your personal life.

You are welcome, also i want you to know that country where i am from got attacked by Russia not one times and my people experienced Russian aggression on our skin. It isn't about this topic but just i wanted to express my support for Ukrainian people. What now happens at Ukraine reminds me Georgia, Tbilisi 5 years ago when one cell Russia was trying to destroy our democracy country. God bless you.

Summer Eyes I agree lawsuits are not worth it but I wish we put up a petition to white house highlighting our problems. If you look at their procedures, it is obvious they don't care. If we put a collective voice and share our stories, we have bigger chance of being heard and our problems addressed. That's I believe how democracy works.

Potential Problem 1: USCIS websites states they initiates background checks when the case is in review state which is practically when the receive the case. I honestly believe if they actually did that than why can't be these checks completed within a year? I think they probably determine and initiates the background when they actually pick up the case to work on (remember those address change notifications?).

Problem 2: I-130 approval doesn't mean the beneficiary is gonna buy ticket and be in US on next flight. There is a long way to go after I-130 approval. The best shot to even got to the interview is perhaps 4 months after I-130 approval. So why stall the whole process be put on hold because of routine security checks? If the marriage is legit, the case could move to next round and security checks could still run in the background.

Problem 3: I know a guy whose wife had to wait more than a year AFTER her interview at embassy due to security checks at that point. Now this is scary proposition. If our cases are being subjected to additional security now what should we expect after the interview? I just don't know.

So I do think we need a petition to white house. All this effort will be in good faith to highlight the problems with the system and fix them.
