Hi!

Me and my fiance' started the journey last week. We mailed our I-129F on August 10. I am worried because 2 years ago I applied for a student visa but was denied because I was not able to show enough proof that I will return to my mother country.

The reason why I applied was because I wanted so badly to be with him at that time. I wanted to go to the US in my own terms so we could be together but I failed.

Is this going to affect our K1 petition? This has been bothering me ever since. Can someone please help clear my mind about this.:(

Should you current K-1 visa petition be approved, and you have a visa application interview, you will be required to fill out a DS-156. On that application, you will have to disclose your prior visa attempts. you may be questioned about it at your interview.

Please remember that this entire visa process is their ball game, their playing field, and their rules, NOT yours. There are consequences for trying to circumvent their system. Hopefully the strength and completeness of your current pending petition (and subsequent application) will prove to the CO the validity of your visa application. You should concentrate your efforts on the current visa process.

shouldn't be a problem. Just tell the CO that you applied for a students visa and was rejected. Dont even dare and try to hide anything from the CO. If you did and he finds out (and im assuring you he will), that's when he'll deny. It might not help you if you tell him that your agenda of filing a students visa before was to be with your fiance. Just tell him you applied for students visa and got denied. no need to expound. my fiancee applied for a tourist visa in 2011 and got denied too. we were aproved on our k1 aplication. just be truthful with all your answers on the interview. good luck!
