Hi friends,

I am writing because I need some information. My husband came into the states under a K1 visa last july. We got married in August and filed for AOS in September. Had an RFE and sent it in October. Since then we had not heard a word from USCIS.

My husband called a couple of weeks ago to inquire about our case and we got the below e-mail yesterday:

The status of this service request is:

On August 5, 2013, you or your representative contacted USCIS concerning your I-485, to notify us that you believe your case is outside of our normal processing time. Below is a summary of what we found and how the issue has been or may be resolved.

Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below.

has anyone ever had this happen? I wrote a letter to my state senator yesterday in the hopes that he can help expedite our case. My husband's work permit and DL will expire in November. What can we do in that case?

This seems to be their standard answer and their way of telling you to quit bothering them. I have read this generic answer in many posts of other members on here. As someone else said, you can renew your husband's EAD up to 120 days before it expires, and with the new EAD he should be able to obtain a new DL (depends on the State though). Good luck; you are not alone - we are all in for a long wait!
