Hello Dears ,

I'm gonna start my visa journey soon at last .

I've already posted some questions here befor , but now it actualy happening ..

Me and my girl friend ( future Wife) are planing to get married in Denmark the upcoming november .

Then we will file for the I-130 and then may be for I-129 for a K3 visa.

So now when I really need some advise :

I was in the US on a student visa ( F1) from 2002 to 2004 and I felled my status ( I become out of status) since I've went to college only one year instead of 2.

When I got a new I-20 to readjust my status it was too late , I ve been an INS guest at jail until I got removed ( other ways deported ) ..

I had a 10 year bar I've over stayed my visa for more then a year .

I know I will have to go throo I-601 and I guess the I-212.

I really prefer if there is any one who was in some how in the same situation to provide me with some informations and wich path should I take .

Hablo español tambien si hace falta par contestar .

NB: I have no Criminal records neither in US nor Europe or in any other country.

What year were you removed from the U.S.? If 2004 then your 10 year bar should be over next year, no?

I am not sure if I can recommend another forum here... but I advise you to try and ask -> http://immigrate2us.net/forum/content.php

A lot of EWI and other difficult cases people there. Some immigration attorneys specializing in waivers as well. (A very, very good waiver attorney- Laurel Scott holds weekly or monthly chats).

Good luck!

Hey Blueberry ,

Thanks for your reply.

Yep I was deported on Nov/17/2004 and I also think since the process takes over a year , but the time the I-130 is approved then it's gonna be the 10 aniversary of my deportation .

I will defenetly check the website you sent and thanks a lot for that.

I wouldn't bother with the K3. It doesn't go any faster than the CR1 and it's more expensive.

I think most of your questions have to do with waivers and if you need them am I correct?
