Confused...Is it possible for the case to skip the NVC?

Hey everyone!

I have some questions about the process. I have been following and mapping the case process from Peru where I was with my fiancé, and recently got home ad actually saw all of the documents that we have received from the USCIS and am a little confused.

Our K-1 Visa application (I-129F) was approved by the USCIS TSC on July 12th.

I have called the NVC center twice, most recently yesterday, August 12th and they said that they still have not received it. She also asked me if the document that we received said that it had been transferred to the NVC, and as I was traveling, I was not sure.

I just got home and read the paper that we received from the TSC. It is the I-797, Notice of Action from July 12th saying that:

"The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about visa issuance"

Now, when they say "consulate" I assume that it is the embassy in Lima...is that correct?? (there was not any mention of a specific consulate on the document even though it says "listed consulate")

Also, if that is the case, it seems that it did not go to the NVC at all. Is that even possible or should I still be waiting for a case number from them??

Any news or answers would be very helpful. Thank you so much!

It takes some time to get to the NVC though I would think a month is plenty time. It is possible that they don't log it until they actually work on it. I seem to remember that when we were in the K-1, it was only when they had actually assigned a number when they had a case number (different to the 129 one), log it and were getting it ready to send it to the embassy.

I don't know what current NVC processing times are and you could check in Igor list or hopefully someone here will post some info.

It will definitely be sent to NVC, all they are though is an intermediary between USCIS and the embassy, they only assign your new case number and send it onward, which is why the standard wording on the NOA2 says that it's been forwarded to the consulate. If it's been a month I would start being insistent with NVC and USCIS. Start calling both and see if they can get someone to confirm that it did leave USCIS and it didn't get lost in the shuffle... what the above poster put is correct though, it's possible it's sitting in the NVC mailroom and hasn't been scanned into the system yet, NVC won't have record that it's there until it gets processed... good luck!
