Hi everyone,

I came to the U.S. from Ireland in April 2013 on a K1 Visa, I am now married and in the Adjustment of Status process.

I filed for Advance Parole with my AOS packet as I want to attend my sister's wedding in Italy this month. However my AP is still in the "Initial Review" stage and

I'm worried that I will not get it on time.

I am a citizen of both Ireland and Australia and so I have 2 passports, the K1 Visa was issued for my Irish passport.

My question is if I travel using my Australian passport, can this interfere with my AOS? I understand that it is always a risk leaving the country while this process is ongoing but I

really don't want to miss my only sister's wedding. Does anyone have experience with using a second passport or have any idea on whether I have a better chance of being able to re-enter to U.S. without

the passport containing my K1 visa?

No way. Very bad idea.

A lot of people think that having a second passport lets them do various tricks and whatnot, and that is NOT TRUE. If the person, that is you, leaves the country while AOS is pending then your AOS will be abandoned. That means you will be stuck outside the US and need to start over with a spousal visa. Having another passport doesn't change that.

When did you apply for AOS? The wedding is this month? Like in less than 2 weeks? You can try to get an emergency AP but usually something like a wedding doesn't cut it, but you can try.

I applied for AOS, AP and EAD on May 28th.

Yes the wedding is at the end of August, I was considering applying for emergency AP but as you said, I don't think a family wedding constitutes an emergency unfortunately.

I feared exactly what you are saying about the passport situation but I just figured I would come on here and get some feedback anyway.

Okay, so you are at around 2.5 months? Your AP should be approved soon. You can try for a service request or make infopass and ask for an emergency one. You might have better luck since it it close to the 90 days.

Ya, I say try for emergency AP nowish.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

I you leave without the AP or GC, you WILL NOT be allowed back into the US. Then you have to stay away for about a year until you receive a CR-1 visa.

Thank you all for your responses.

I will call NCSC and see if I can expedite my AP. If that fails I will try to follow up with my Infopass appointment.

I will post an update on the results.
