My Case Status, no update after USCIS received RFE Packet (i751)

Hi everyone,

I hope someone can help me. I did an extensive Google search and even called USCIS but I can't quite find an answer to my question, and frankly, I'm freaking out a bit.

My husband and I received an RFE back in May with a deadline of August 17th to submit it. We went on a few, small vacations - the last one ending August 2nd - and we really wanted to wait to include pictures, documents, receipts, etc. from all of those trips, incl. the most recent one. I mailed the packet (finally) via certified mail and it arrived Aug 9th. Unfortunately the USPS lady didn't understand that I want someone to sign for the packet upon delivery, so there's no signature confirmation (UGH!). Now, My Case Status on USCIS is not updating. Aug 17th, the deadline, is merely days away and I have no idea where my RFE materials are. I called USCIS earlier to talk to them and the gentleman on the phone said, when I asked what I should do, told me to just wait and they'll get to it eventually. Now on to my question....

a) I read about multiple cases where USCIS claims they never received the RFE packet. Can this happen even though I sent it certified? :(

b) Is it normal that the My Case Status is not updating? It still shows our change of address back in May as the most recent occurrence

c) I can apply for citizenship at the end of September... what happens if I do (I am planning to), then USCIS comes back and says they never received the RFE?

I'm honestly mortified. I just quit my f/t job a few weeks ago because I will be going back to school. My husband makes enough to get us through , we're both still young and don't have savings. I'm on the verge of having a nervous breakdown thinking about getting a lawyer or rather, having to pay for one with money we don't have. :(

This is the question I forgot to ask, and I can't edit.

What happens if my 1-year NOA extension expires, and I haven't heard back from USCIS yet? Does that mean I have to quit my job/quit school and wait for them to respond?
My GC expired in Dec 2012, and so my extension would expire Dec 2013. I'm honestly terrified. :(

If your extension is going to expire you just have to go to your local USCIS office and ask for another extension. Also, my case status didn't update either even after I got delivery confirmation for my RFE packet. No touches or anything. So don't worry about that.

As far as updating, I think you are okay. I think it takes a little while to update.I would not panic about that.

About the mailing, did you request tracking?

The USPS has a new process where the tracking and signing is on the same form. When I mailed mine, they have a new red print form that is both the tracker and signer. But since this did not happen, did you get tracking. If so, that should be enough.

If none of this happened, honestly panic will not help. Not everyone's files are lost so hopefully, yours is not.

UGH!!!

a) If you had tracking and delivery confirmation (even without a signature) then you know your package got delivered. Don't worry about what has happened to other people - not everyone sends it with tracking. If USCIS claimed they didn't get your package, you have proof of delivery to challenge them with.

b) Completely normal. There are tons of people who get an approval letter for their ROC and the online status never updates. I wouldn't read anything into it. Also, if the package only got there Aug 9, they probably haven't even looked at it yet. It usually takes a few weeks for RFE responses to be processed.

c) Again, if you have proof of delivery, you can challenge their claim. But since this is a bit of a far-fetched scenario, I would urge you not to worry, particularly since there's nothing that's worth worrying about at this stage.

Nope. Since you applied for ROC within the time window allowed, you continue to be a permanent resident with all the rights a permanent resident has until there is a decision on your case. If a year goes by and you still don't have a new green card and the extension letter expires, you should make an InfoPass appointment with your local USCIS office and they will give you an extension stamp on your passport for another year.

There is nothing to worry about cases are taking very long, it sucks. I filed in July 2012 and recieved an RFE in march and still no updates. They dont usually tell if they recieved it. I just got back from my info pass appointment to extend my status. All you have to do is go USCIS website and make an appointment and bring your passport and put a stamp in it. Also do a service request either by phone or e-request. You can also ask to speak to officer about your case, I did and all they told me was that my case was at my local field office waiting for interview. But i had to wait 92 mins on hold to find that out. lol
