Where did you do the proxy marriage ? Only about 4 states allow it and only under limited circumstances. I believe the only petitionable unconsumated proxy is a narrow class of US service people under active deployment orders

That means it s illegal even if I did it in morocco

Does this mean both parties were in Morocco when the marriage took place?

Where was the husband and where was the wife during the proxy marriage?

Casa is a VERY difficult consulate to deal with, I suggest you begin reading about what you need to do at the interview stage

The day tat we got married I was here and she was in morocco,that s why we did proxy.my question is as far as I am showing that it was consummated.is that ok in Massachusetts?because the letter that I received from them does say only if our marraige was consummated it doesn't t say if it is legal or not? I am confused plzzzzzzz clarify to me

Here is a law website that talks about proxy marriages. Says you have to have been married in one of the four states listed. Massachusetts is not one of them. See here: http://www.kvisas.com/Proxy-Marriages.shtml

Yes we both from morocco.i send a proxy to my father to get me married because I was still under training in my job.the proxy marriage is allowed 100% in our country.but last week I received a letter form USCIS saying that we need evidence that u met ur wife from the date of the marriage till the time you filed for her,in that period I was still in boston I went 3 months later.the thing that I wanna know is it legal in Boston?i read that it s only legal in 4 states.and if this is not legal here they ganna tell me that at the first letter? Am I right?

I think they neglected to tell you. What proof did you send of your marriage? At any rate, did you actually meet in person with your wife between the time you got married by proxy and before you filed the petition? You haven't given a clear answer about that, although from others I am deducing that you have not.

Are you saying that the first time you met her was 3 months after you filed?

Even if the marriage is legal under Moroccan laws, it may not meet the legal requirements for an immigration visa.

Not all foreign marriages are good for immigration visas. For example, bigamy is legal in some countries. It is not legal in the US. If a person has a bigamist marriage in Saudi Arabia, the marriage is legal in both SA and the US. The big problem is that bigamy is illegal in the US, so the US resident has committed a crime even though the marriage is legal.

The above example is to illustrate that not all foreign marriages that are legal are acceptable for an immigration benefit.

If you want the immigration visa, then you have to do it the way described by US laws. The way you did your proxy marriage is not acceptable for an immigration visa.

You must be legally married and have consummated the marriage prior to filing. It appears you marriage was not legal by US law and it was not consummated as required for Immigration purposes. Your petition will be denied. Might as well withdraw now. Are you legally married in Morocco? It appears your marriage is not legal in the US but it could be legal in your country.

You need to withdraw your petition and refile because you did not consummate the marriage until AFTER you filed your petition. Either that or wait for it to be denied and then refile. Those are your only options

The proxy marriage doesn't need to be legal in the US, it needs to be legal in the place it was done in. Which is true in this case. The proxy marriage then also needs to be consummated afterward for visa purposes which had not happened when the petitioner filed his petition, so it will be denied. He now has a petitionable-marriage (for a new petition) because he has met his wife since the proxy marriage (and after he filed his petition).

Now you have a petitionable marriage, but your old petition will be denied. That doesn't take into account the questions you will be asked, like why wouldn't you give a real wedding to your wife, but that is a separate issue from the legality.
