First let me say to the administrator I am not certain where this post should be feel free to move where it should go.

VJ'ers I need your opinions on what to do. I will be as brief as possible. Our K1 interview was 5/28 and fiance was told approved and was provided instructions for registering for passport delivery through DHL with green stub attached. On 7/2 I contacted DOS regarding the status of our case and was told case was pending 221(g). I was given info about the law. I emailed the embassy and on 7/9 received a resposne from the IV unit at Kingston stating no discrepancy with the 221(g) and applicant would not have received anything in writing.

After waiting some more my congressperson made an inquiry that was received on 7/31. Today, my congressperson received a response to her inquiry. A copy of the letter is attached. Here is whsy the embassy said in response to the my congressperson inquiry "

As you are aware, XXXXX applied for a K1 fiancé visa on May 28, 2013, but was found ineligible to receive a visa under Section 221(g) of the Immigration and Nationality Act. This section prohibits the issuance of a visa to anyone who has not provided all the documents or information necessary to establish his or her eligibility for that visa. Specifically, although all the required documents were submitted, XXXXX application was temporarily undergoing administrative processing." By the way aren't they supposed to respond to congressional inquiries within 48 hours?

After reading the letter I am infruriated and feel we have been waiting unnecessarily.I feel they made a mistake and obviously will never admit it. I know I am just one little constiuent, but I have a voice and I have the constitutional right to express my voice. I understand a visa is a privilege. I made an inquiry asking about the reason for 221(g), requested something in writing (as required by procedure/law), and the embassy responded with a generic no discrepancy and no need for anything in writing. My fiance has been in a depression, barely has appetite. I have spent countless nights crying, barely sleeping, and completely unfocused in a high demand position. I know in my heart the email unit is not doing their jobs. There have been countless examples where VJ'ers are complaining how this embassy has been handling the processing of visas.

Here is what I'm asking. My heart is a bit conflicted right now. Should I kick up the sand and write letters to the ambassador, chief mission, and white house, or should I I just bend over take it and keep my mouth shut for fear of retaliation? I mean my fiance will still need to go through AOS and eventually citizenship and I wouldn't want extra scruitny because I complained.

My point of view is not only feeling like I was screwed, but I feel something should be done from preventing this from happening to anyone else. If applicants and petitioners are held to procedures and requirements of the law, then so should federal employees paid by Amercian citizen tax dollars. We can file a complaint about any other federal agency, but US embassy are favored with the umbrella of national security and the fact that applicants technically aren't US citizens therefore have not rights? (i.e. visa is a privalege not a right)

What ever insight anyone can offer is appreciated.

Oh on 7/31 CEAC status updated, updated again 8/2 and then again 8/7. All these updates before they responded to the inquiry. Hummm makes me think they are getting a move on a file they knew did not need to wait this long.

I'd love to hear other thoughts on this, as well.

My finace and I are getting the same crappy, run-around response regarding our case in AP.

The Embassy even filed his passport with the wrong case, and they will still not address that issue.

We've been in AP for almost 8 weeks, and I can not get any answers from the Embassy, other than we are in "review."

My finace and I are terribly frustrated. :/

sorted out sooner than later, do not let the delay

kiil your spirits, very surprised nothing happened

for U yet I went on vacation surprised to be back & U

still here in limbo....I would make some contacts with

these people but I would use the attitude of concerned

instead of attitude...I am beginning to believe something

is going on in Kgn I know an individual they contacted for

a document they already had at the interview, and he got

some kind of green paper & DHL information...maybe a fall

out from the case few mths ago with an artiste & an agent.

Stay positive....What is fi yuh...cant be un-fi yuh.

stay positive...be careful complaining to the white house. I did and received a response and now it kooks like everyine around my receipt number is getting approvals and I am stuck waiting. If you decide to contact and start a letter campaign be careful with yout wording to not piss them off and they screw you around. Best of luck

June 24,2015 EAD/AP combo card picked up by USPS

June 25, 2015 EAD/AP card received

October 6, 2015 email stating greencards in production!!!

I did read any change in administration slows down the process. So it could be the whole scandal that is effecting the way the process. however, there have been a few incidencies where mistakes are being made. Also, lots of inefficiency with how files are processed. It should not take this long if a case is not being sent for an SAO.

Beancamp I understand how you feel. I use to be comfortable counseling individuals with depression and anxiety until my recent experience with immigration. This is one experience that can make people extremely depressed. Goodluck to you. I just pray that we'll both get approval soon.

Thank you Dee&Tino. We did get our visa issued on 8/13. I hope you hear the good news soon. This process defintely puts a strain on your emotions.

You're welcome Beancamp and CONGRATULATIONS! :)

Unfortunately my fiance was not told that he was approved at his interview. Our case seems to be extremely difficult. I believe they are treating my fiance as if he killed someone. I admit he made a very stupid mistake almost 12 years ago but we certainly didn't think he'd have the problems he's having now. I haven't even tried to get help on here because I've been so busy sending emails to the embassy, contacting congressman's constituents representative, and having several consultations with Lawyers. I did all the paperwork for k1 without a Lawyer but since my fiance's interview on July 23rd I've been wishing I had one. Anyway, at this point I'm just drained...

I hope you and your honey are enjoying each other now. I didn't realize that you got the visa since that first post.
