So I'm assuming we don't have to wait around for (at least) 10 days to get married now. Maybe leave a few days for the actual SSN application though, no?

Isn't it no white after Labor Day? All of us girls with our wedding dresses, eh? ;)

Is it recommended to take your own copy of I-29F with you to the States, to help with AOS?

Nich, thanks once again for your help (in the other thread!)

You don't need a SSN to marry or file AOS. AnnaGrant's experience was an odd one. Get the SSN whenever and marry whenever (within 90 days of course.)

I-129F to states? If your fiancé doesn't have a copy sure. It may help you fill out the the new G-325A without having to look up addresses or employers again.

Labor Day lore--

A fine southern lady would not wear white SHOES after Labor Day. Nothing to do with wedding garb.

And don't wear velvet after Valentines Day.

The color of your wedding dress depends on what looks best with your coloring..skin tone and hair. Some choose white and some choose off-white, candlelight, ivory, champagne (haha pick a name) My daughters wore slightly different shades of not-white silk because the same dresses looked dreadful on them in white.

The days suggested was to allow the record of your entry to be recorded manually from the top half of the I-94 they keep so it would appear in the database SSA uses to find the entry status and name. With the I-94 going automated this summer, there really shouldn't be a delay because it all is electronic with data populated by scanning your passport. There is no I-94 card to fill out and tear off half for you and half for Homeland Security. I would guess if you find your I-94 record online, it is also already in the S.A.V.E. database.

There is nothing to hold you back filing except having the proper documents and your lawyer's sense of urgency, which may not match your wishes.

Documents needed you can't do in advance--

*I-94 printed off website. Should be immediate.

*Certified marriage certificate. That depends on your county. With mine when we purchased the license she said we could bring it back in (signed and dated by the officiant) and get instant recording and the marriage certificate or mail it back and they would mail out the certificate. We married on a Su day afternoon and before lu ch on Mo day I had the certificate in hand.

I filled out everything for AOS before he got here. I fully Intended to mail it the day after the wedding but we messed around and didn't get it in the mail until Wednesday or Thursday. All I really needed to do was photocopy the whole thing for records. That was about his 9th day in the country. He had EAD approved something like 71 days after POE I believe ... Oct 1 to Dec 11.

thanks Nich-Nick - as usual. :)

uh by messed around, do you mean busy doing other stuff or uh messed around? Inquiring minds want to know. J/K. :D

Are you sure this is the standard rule? I called my county's courthouse, and they said they cannot allow anyone to marry if both participants do not have social security cards. We had originally planned for my fiance's family to fly to the US with him, but I don't think they want to be waiting around for 2 weeks doing nothing!

Is there a different law for K1 visa holders? I asked the lady at the courthouse, and she said it is not possible for them to even type up a certificate, because it requires the SSN for both parties in their computer program..

Not really sure.. Although, laws regarding requirements vary from county to county anyway, so perhaps she is right.

Also, Nich-Nick, when you say that the I-94 is online, does that mean that before my fiance flies the the US, he will need to fill that out so that he has it at POE? I am confused about the whole I-94 thing, as I had originally thought it was the landing card that is given to people mid-flight!

Both. :P Hahaha.

We had hurricane damage to repair and insurance adjusters and roofers to meet with. Hadn't factored a hurricane evacuation into our wedding/AOS plans. I couldn't have planned a more unsavory "welcome to you new home" scene.

Each county or state could have their rules, but usually a SSN is not required. My county for example posts on their website bring photo id, SSN, etc. But in speaking to them they said if one has a SSN, they must give it, but if not the foreign passport was sufficient. Maybe clarify again with a supervisor. Maybe they don't get many foreigners there and the clerk was unfamiliar with what to do with one. And maybe it is a state law. But not everybody is successful getting a card in two weeks. Some take months.

Landing cards (i-94W) were discontinued for VWP a few years ago. For visa holders (I-94) landing card went paperless this summer. It is automated, but you can retrieve an online record of your entry (after arrival) to print out and take to Social Security and include with your AOS paperwork . The only thing handed out on the plane is the

Customs declaration....what are you bringing into the country, have you touched livestock, etc. White form with blue band at the top. Fact sheet about I-94 http://www.cbp.gov/linkhandler/cgov/newsroom/fact_sheets/travel/i94_factsheet.ctt/i94_factsheet.pdf

Oh, you can actually apply before the K1 visa is received? I didn't know that!! I am assuming, though, that you had to be there, is that right? I couldn't just go pick one up with Jake still being in England, I don't think.. The clerk might think I am nuts if I go to that alone, so I should probably hold off!! haha I will call the courthouse again today and see if I can ask if they have applications for marriage licenses that do not require a SSN. Thanks for the tip!!

Thank you so much. I had assumed that the clerk had most likely never dealt with a K1 visa, so I think I will call back and get some information from a supervisor..

As for the I-94, you are a life saver!! I never would have known that, had I not asked. I tried searching in the other forums, but I couldn't find the answer I was looking for.. Perhaps I am the only one that was left in the dark on that one!! blink.png

Marriage in Indiana http://www.in.gov/judiciary/2605.htm is that your state? It does say Ssn, but mine said that too and he didn't need it. There is a place to click your county for more info. You might say you are marrying a person from another country who does not have a SSN, so what can they do to accommodate that? Ask for a supervisor too. You can always go to a destination in the next state to be married, if it is not already planned out.

Awesome you got that done already smile.png

What's interesting - on the NJ website for our county, it says under things to bring with you "Social security card or number"* and the asterisk says "Social security number is required by law for US Citizens and will be kept confidential" so to me, he's not a citizen so shouldn't need that?

good to know you needed a different form - I have to call the woman tomorrow anyway to see if they take the applications during normal hours or by appt, so I will ask if our county needs a different form. smile.png

Okay, thank you! It seems that we will probably be fine without him having a SSN, but I will call tomorrow just to see if I can get any more insight.

Most states show that the SSN is required and most states do require it of all US citizens applying for a marriage license. Most states though allow non-residents to get married and waive the rule for non US citizens. Only people who will know for sure is the licensing agency in your state, but I'd think they could just fill in the form with 000-00-0000 for non US citizens. I have checked mine and it is required for me, but not for my fiance, but I'm not in Indiana either

Yea thats the term they used "non-residents" for my form!

Perhaps I am the only one that was left in the dark on that one!! blink.png

Yea I had to be there and my mum was with me as the witness! They said the license is onyl valid for 30 days but we can just leave it at the townhall until the last minute and the 30 days wont start until we pick it up.

Thanks for the tips, everyone..

I am wondering if anyone had any updates from the embassy today. They are still showing that they have not received our packet 3.. even though we sent it nearly 3 weeks ago! I am getting so impatient!!

Met in 2006 through a pen pal website for school-aged kids when we were 15!
