it's 265 days ago after NOA1 and still waiting and waiting :( ...

the last message we got says:

"On July 22, 2006, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location."

My fiance contacted the congressman and the senator it was 1 month ago,and we are still waiting and waiting...

I am so sorry you are stuck like this. I know AndyMisu went pass the 60day mark and was able to send in a expedite request. This type of expide is different from the normal expedite that is usually referred to in pushing a case forward. I would suggest PMing him. He can give you the details of which form he used and how it worked.

Also if I would follow up with the Congressman or Senator. Or maybe try one of your other represenatives to see if their immigration aide is better at handling this. I can't see your timeline to know when you filed and if you are outside of normal CSC processing time, but you are outside the 60 day window they gave you and I would try to use that to get an answer.

With that early of an NOA1 date, you should be able to get some answers from USCIS. You are well beyond their processing times. If that fails, contact your senators and such. At least that would be my suggestion.

Man you are getting hosed... If I were you I would call the CSC, senators, congressman... anyone that might be able to answer your question. That is just outright ridiculous! Don’t just sit back and let this happen to you make them miserable and tired of having to talk to you 10 times a day.

I agree with what everyone has said, CONTINUE BOTHERING THEM by all means, don't give up, call them up, call your sentators, congressman, anyone who can help you out. You deserve an approval, NOW. Good luck and let us know how it goes. :yes:

Mellarbi did your fiance sign a release from from the congressman's office for them to proceed and followup on your case? If they did not sign a release form they are powerless and will not contact any agencies on your behalf.

Secondly, once you sign over the rights to the congressman or senator's office the USCIS will contact them with all information reguarding your case on updates. The USCIS will still forward you all paperwork, forms, etc that are necessary for your case but will not respond to emails for an update.

I would contact the person or persons that the fiance had talked with previously and ask them to do a status update on your case. That person should be able to tell you if the USCIS has replied to them. In our case my congressman would not help us but our senator did inquire for us. I will also say that if for some reason your name is being hit in one of the many data bases there is nothing that can be done to expedite the checks but you will have peace of mind that you are not lost in the processing.

Good luck and make sure to recontact your offical that was asked to help you in the first place.

You need to try and find someone in one of those offices who actually gives a #######. The person at my congressman's office is a very nice guy, probably too nice. He inquired for me, but just accepted whatever BS CSC gave him and then passed it on to me. The person at one of my Senator's offices was like actaully calling the USCIS customer service phone line, she actually read my case status to me over the phone and then read the processing dates to me just like customer service grrrrrr. But one great lady at my other Senator's offices wouldn't take CSC's BS. She kept after them until they committed to giving her some type of definitive information by the end of November. And walla we got our NOA2 the end of November. Remind your fiancee that she has 2 Senators and one congressman, I'm guessing she knows this but just in case. I would also have your fiancee call USCIS. Your petition is way outside normal processing times and should start an inquiry from your end. Whether it will do you any good is another question. Good Luck. Hope to see an approval for you soon.
