If you spend 95% of your time in the USA, I'm not surprised the CBP demanded you give them a return date and have proof of ties. And yes I think it's very risky to try and AOS after you told the CBP

Please keep us updated.

We received a message yesterday afternoon stating my wife's EAD was placed into card production. Our I-485 and I-130 status haven't changed as of yet, but the EAD approval gave us some much needed relief. Our RFE had me very nervous. Hopefully this is a sign that USCIS will move forward with the I-485. I can't imagine they would approve the I-765 if they still had doubts on how she entered the country.

That's good your wife got her EAD. Did you get an interview date yet?

An I-765 and I-131 are processed by different departments than the I-130 and I-485. The only thing they care about when approving the I-765 is that she has a pending I-485 that was either previously filed or concurrently filed, that's it. It's neither a good or bad sign with regards to the main applications, but obviously it's a good thing in the grand scheme of things.
