Help with Sibling/Daughter Green Card

Timeline

Wife is recently naturalized US citizen. (Thanks Visa Journey for all your help since 2006 to help with that process.)

Trying to bring adult unmarried sister to US as well. (From Russia) Trying to find the quickest way to get her a green card.

Background:

1. Sister has visited us on a tourist visa multiple times. Last time for six months. Always on time, no overstay, no issues.

2. Father's green card petition recently approved. Waiting for interview and visa issuance in Moscow embassy on 23 Aug.

Questions.

1. Is it faster to submit i-130 for sister from U.S. citizen (Option 1) or as adult unmarried daughter from Permanent Resident (Option 2)?

2. Is it possible for sister to be here on tourist visit and then be able to stay in U.S. while adjusting status? Option 1? Option 2? (I think this is called concurrent filing)

3. If sister is out of US when petition is filed, can she come to visit on tourist visa during the waiting period (which could be years)?

Thanks for your help. I tried to find these answers... hope I'm not asking dumb question(s)

NOA1 hard copy: never received due to address error

06/12/2013: NOA2

06/17/2013: NOA2 hard copy

06/17/2013: NVC received our case

06/28/2013: Case number assigned

07/01/2013: Sent DS3032 via email

07/03/2013: Recieved i864/DS3032

07/03/2013: Payed i864 bill

07/06/2013: Sent i864 package

07/08/2013: i864 package delivered

07/16/2013: Sent DS3032 via email second time (supervisor review)

07/17/2013: Rejected DS3032. We did a typo!!! Sent correct DS3032.

07/29/2013: Checklist for AOS

08/01/2013: DS3032 accepted

08/02/2013: Sent response to AOS checklist

08/02/2013: IV fee paid, IV package sent

08/05/2013: NVC received reply to AOS checklist and IV package

08/30/2013: AOS accepted

09/03/2013: Case complete

09/04/2013: Second AOS checklist that has to be taken to an interview

09/10/2013: Email notification about case being complete

10/02/2013: IL received

10/11/2013: Case status changed to "In Transit"

10/14/2013: Passed medical exam

10/16/2013: Case status changed to "Ready", received email from Consulate regarding interview procedure

10/22/2013: Filled DS-260 online

11/18/2013: Interview date. Approved

11/21/2013: Passport with visa picked-up

Thanks for your help. I tried to find these answers... hope I'm not asking dumb question(s)

1) option 2, depending if she is under 21 or over 21? siblings take around 12 years no matter how old she is. if she is over 21, then the wait for father's petition is around 8 years, and she cannot marry as long as her father is a LPR.

2) no, she cannot adjust status and wait in the US. she can come to visit, but never overstay

Timeline

A sibling petition is about a 12 year wait and no the sister can't stay while waiting.

A petition for an adult child of an LPR is about an 8 year wait, she must remain single and no she can't stay while she waits.

Sibling petitions may go away if immigration reform passes in it's current form

This will not be over quickly. You will not enjoy this.

1. Guys are absolutely right. Your sister falls under F4 category if you petition her, waiting time is 12 years now. If your father petitions her, she falls under F2B category and waiting time is 8 years. Your dad can obtain citizenship and then she will fall under F1 category, you could save 1 year. However, as already said, she should remain single all these years if father is the petitioner. Also, a lot might change and these numbers are valid only now. 2. I don't think she can, Travel visa doesn't allow immigrant intend.

3. Same here. My husband was denied Visitors visa, because of pending immigrant petition. But since she already has one... Well, I can't tell for sure, but this might raise a red flag and question if she obtained her visa without fraud.
