Just a quick update from us. We spoke with our lawyer tonight and we're pulling the I-130 currently with the NBC and going through DCF. Thank you everyone in Aug for their listening, help and overall company. I'll still be watching this thread to make sure that things move in your favors as well.

I was going to write to you tonight, What did your lawyer say about why they didn't mention this before? We are preparing an new petition also, but have to wait until 28th Feb to meet the 6 months residency requirement..... no NVC to deal with

..... Did they say pulling the i130 and re-filing straight away would be an issue?

February 18th : Transferred to California


February 26th : NOA 2

The long and short of the reasoning isn't something that would give anyone else problems. That's all I'll say about that. ;)

He didn't mention any problems at all with pulling the I-130 and refiling. The only worry he had was that we were going to travel to the US between now and when we got the visa approved as sometimes POE can be difficult for those that file DCF. But, we didn't plan on going back until July, and crossing fingers we'd have this process done by then.

We're getting the new docs in the mail to London on Monday morning.

June 2001 - Met

October 13, 2006 - Married

December 26, 2006 - Moved to the UK

June 26, 2013 - DOMA struck down as unconstitutional

August 05, 2013 - Lawyers sent I-130 to US-based service center

August 07, 2013 - NOA 1 from NBC

January 2014 - Contacted US Embassy in London, decided to file through DCF, fired lawyers

January 26, 2014 - Withdrawal letter mailed to NBC

February 01, 2014 - New I-130 filed with London Embassy, waiting on withdrawal of 1st I-130

February 05, 2014 - First I-130 transferred

February 10, 2014 - Second Withdrawal letter mailed, faxed & emailed to CA Service Center

February 13, 2014 - London accepts our second I-130 application (emailed notification)

February 18, 2014 - NOA1 received, dated for Feb 13th.

February 25, 2014 - Notice received that first I-130 officially withdrawn by California Service Center

March 15, 2014 - NOA2 received, dated for March 13th.

March 28, 2014 - LND number received via post

April 04, 2014 - Medical appointment

May 15, 2014 - Readiness completed

May 30, 2014 - Appointment date received

June 05, 2014 - Interview date - APPROVED!!! Issued same day.

June 11, 2014 - Visa in hand.

July 30, 2014 - POE in Shannon, Ireland - then onto Boston and home!!

Cool! let me know how it goes, my wife is on a Tier 4 visa here and I am glad this counts.... DCF can be short!

Had the fortune of spending over a month with my wife. Anyway I've read every post here through email forwarding. No point in adding me to the transfers database unless we start to see August transfers. I think Monday will be the deadline to really see whether transfers have stopped or if there we still have chance.

Eitherway stay strong everyone!

Always double check your documents and forms. Not only do you get delayed by RFEs and Checklists, but the time it takes for them to review the new items you send could be used to approve more applications. Save yourself and others valuable time!

Current Status: NVC:
-Assigned and Received NVC Case Number, IIN, and BIN April 18, 2014. (100% sure case # was assigned today because I called twice and it wasn't assigned in the morning when they opened but in the afternoon it was)
*Could not provide email then as case was still being updated in their system
-On April 21, 2014 I was able to provide my email and beneficiary's.
-On April 28 I was able to fill out DS-261
-On April 29 I received and paid AOS Fee (at 1pm)
-On May 1 I received and paid IV Fee (at 1pm [became available]), also AOS Fee shows as PAID
-On May 5 IV Fee shows as PAID and DS-260 became available and was completed. Also, AOS Package Scanned by NVC

-On May 7 IV Package Scanned by NVC

-On May 28 AOS Accepted

-On June 2 IV Accepted/Case Complete

-On June 11 Interview Email Received

-On July 3 Interview at Moscow

Note: Medical Exam scheduled after interview letter received by calling the specific clinic, earliest appointment was 2 weeks ahead)

-Visa approved, came to us, got greencard, sadly things didnt go well and divorced. Last I hears she was still in the US and got a full greencard (I notified USCIS of divorce though)

Should we take you off the transfer sheet (we could have you a dcf filer if you'd like) ?

You won't get transferred obviously.

We record just to stay aware of how many filers.

Whenever you transfer, I make note of your transfer center and modify the worksheet.

You won't get transferred obviously.

I think for the sake of keeping the data as accurate as possible, I should be removed. I'm not an Aug filer anymore - I'll be a Jan '14 filer.
