Timeline

What about if we have no job (per say) , but are full time postgrad research students? Both my wife and

I are at York doing marketing research, we have a long house lease here also etc etc, will this get flagged?

it cost me £20k for her to study here (non EU's don't get grants) so surely they could see I'm not THAT desperate

to get into the US that I would waste £20k!!

Also my trips over the last 2 years have been 5, and for 3-10 days in total (Christmas, budiness trips and her brothers wedding). I am british if that makes a difference

Are my chances ok?

Honestly, I think you will ok. Reason why I say this, is that you have not shown a pattern of long term stay in the US.

Carrying with you documentation of your ongoing studies, a copy of your lease, mobile phone contracts, bank statements, showning the UK as residence for the both of you is good evidence in the instance that you are questioned further about your intent of staying in the US.

Copy of the NOA1 showing that you have filed for a CR1 is also proof that you are planning on returning back.

I have only heard of one UK resident that was denied entry at POE. He was the fiancee of a friend of my husband's. He had no job, no apartment, no ties whats so ever in the UK and his return ticket was for 90 days later.

It comes down to whether you want to risk it or not. There is always a chance of you getting denied entry. Im willing to take that chance because I want to see my husband! And should i get denied, the financial loss is not very significant for me.

Going into a secondary interview doesnt automatically mean you will be denied entry. Its your chance to dig out all the proof you have with you to convince the CBP officer you are intenting to return back.

I wish my husband could visit here :(

After studying on VJ, stories of members that got denied at POE, and also seeing at work people that have been sent back (I work for an airline at ATH airport) and talking to them, there are two major factors that play a role in if you will get denied or not.

1. If you have a job in your country of residence or not, and

2. The length of your previous visits and the frequency of them.

For example, entering for 90 days, leaving the US for 3 months and trying to re-enter again. That starts to raise warning bells for the CBP.

I know that the fact that I work for the airline I fly into the US with helps, I wouldnt be entitled to their free tickets if i didn't and CBP officers know this.

Also I think it helps that in the 2 years I have been flying back and forth, the total amount of days I have stayed in the US have not exceeded 100 days.

Of course, that doesn't mean that every time I try to enter I wont be pulled into a secondary interview, but I have enough evidence that I think I could convince the CBP officer that I am in no way intending on staying.

Fingers crossed for this time around!

Totally sucks. And I know EASTYO is right. But my hormones will get the best of me whether I try to remain strong or not some days. I wish he could get a visa and stay here even for 3/4 weeks around the due date. Sigh..im a perfect world...

Same here ... our first wedding anniversary was yesterday and we missed out on that ! i`ve been crying for like a week,i know i`m over reacting but its really unfair ,and you my dear are pregnant ! i can only imagine how you feel !

Thanks. I admire all of us for one reason or another. Its not even me I am sad for. Its him. Ive had two children. This is his first..and as far as my opinion right now, I dont plan to have more. So for him not to witness his only baby boys birth breaks my heart. I will obviously record what I can and attempt skype or something. But its not the same. And the wifi at the hospital SUCKS lol

heres to hoping for some relief for some of us next week!!!

Just a quick update from us. We spoke with our lawyer tonight and we're pulling the I-130 currently with the NBC and going through DCF. Thank you everyone in Aug for their listening, help and overall company. I'll still be watching this thread to make sure that things move in your favors as well.

Our journey started long before the NOA1 - read about it here.


Timeline:

June 2001 - Met

October 13, 2006 - Married

December 26, 2006 - Moved to the UK

June 26, 2013 - DOMA struck down as unconstitutional

August 05, 2013 - Lawyers sent I-130 to US-based service center

August 07, 2013 - NOA 1 from NBC

January 2014 - Contacted US Embassy in London, decided to file through DCF, fired lawyers

January 26, 2014 - Withdrawal letter mailed to NBC

February 01, 2014 - New I-130 filed with London Embassy, waiting on withdrawal of 1st I-130

February 05, 2014 - First I-130 transferred

February 10, 2014 - Second Withdrawal letter mailed, faxed & emailed to CA Service Center

February 13, 2014 - London accepts our second I-130 application (emailed notification)

February 18, 2014 - NOA1 received, dated for Feb 13th.

February 25, 2014 - Notice received that first I-130 officially withdrawn by California Service Center

March 15, 2014 - NOA2 received, dated for March 13th.

March 28, 2014 - LND number received via post

April 04, 2014 - Medical appointment

May 15, 2014 - Readiness completed

May 30, 2014 - Appointment date received

June 05, 2014 - Interview date - APPROVED!!! Issued same day.
