There were really three groups of couples that were part of this whole wave.

There were couples who had previously been denied a visa based on their same-sex status that were added back into the system. Most of these have already been approved, though, as they went through the entire process only to be denied after their interview.

There were the couples who had already got all the paperwork done and literally sent it in as soon as DOMA was struck down - so last week in June, first week in July.

Then there were couples like me and my wife, who waited for the actual decision to be made before getting in touch with a lawyer and starting that process. We got in touch with a lawyer on the Monday following the decision and got our docs out the last week in July.

I'd be of the mind that not only would July be chock-full of these application, August was as well.

No need to conjecture... We can see if there was a bump in application receipts at that time. post-169816-0-86901000-1389454480_thumb.png

It looks like there was a bump in March/April and the number of new case receipts actually went *down* after that.

And we have to remember that the USCIS was actually getting lower numbers of applications for some time prior to that. In the documents I've been reading, I believe they were discussing what effect the lowered number of applications was doing to the USCIS financially. I'll have to look it up later though, as I'm watching my niece today. 3 little girls under the age of 5 = no more computer time until after they're in bed.

There might actually be a bump that we don't see here, if they're reopening denied petitions that aren't included in these numbers. But to me it doesn't look like it. Increased numbers of petitions wouldn't have been as much of a problem if they'd actually been processing them appropriately. We'd probably still have seen a bit of a backlog, but nothing like we're seeing due to the combination of their inaction, and the slight increase in petition. (Slight being a relative term. It's not like they doubled.)

I really think that they're holding them for a few weeks because Late July/Early August aren't past 6 months yet. Perhaps they think this will give them a chance to actually adjudicate the files that they already have at the service centers, which may actually be good news for you guys. You may have reduced wait times after you finally do transfer. We'll have a clearer picture once they post their new numbers next week-ish.

I think I also just saw some one from April who *just* got transferred. It's' possible that the NBC is still holding on to batches of petitions prior to July that they aren't going to adjudicate themselves. *head desk*

It could be reopening of denied petitions. Reason being that they wouldnt be "counted" as pending or new (except that CIS knows that they exist and are now processing them behind the scenes). These phantom petitions could be very many.

TJsMomSarah tends to believe these phantom petitions have already been resolved.

There's SEVERAL people who believe that that is the case.

Remember how nobody knew which way Tony Kennedy was going to vote - so I doubt that a LARGE number of LGBT couples applied - were denied - and that large group of people is being approved. Even if they did, that pre-June group cant be that large.

That's not it.

It is unconscionable to hold petitions, throw some others into a game of service-center-roulette and tell the rest its-not-six-months-yet.

They oughta hire more people to manage this.

Then again, Mayorkas got a promotion. so... yea..

Im leaving in a week and a half to visit my husband in the US for 12 days. I will probably come back and still be waiting to see a transfer!!

Oh I so envy you. If I could go like once every two months or so this wouldn't be so difficult!

Na ah

They send out receipt notices because they are a satellite office of NBC (to do the clerical work pre-transfer).

Thats all they are.

They were supposed to have trained adjudicators or something by sep of last year.

No go.

Crazy! I wonder the backlash if they miss the may 5 months?

Also it is very obvious that they are on July to bring the average time down, that's why you are seeing so much

movement for July. This means they need to then go back, do the others, then start August.

So we will suffer I think

How do we know Overland Park is not running? I thought they started, slowly, but started?

Overland Park as a centre is operational. Their Division 8 department though isn't. Division 8 was supposed to be opened end of sep 2013 and they were supposed to deal with all stand alone I-130 petitions.

Overland Park has never up to this point adjusticated any petitions.

Even though there have been members that never got transfered from NBC and have been approved, none have reported a NOA2 hardcopy from Overland Park. All approvals have come through Lee's Summit.

Actually that's not entirely accurate. If memory serves me right, not sure if it was April or May 2013, filers started reporting receiving NOA1s from Overland Park with MSC code. USCIS started to send I-130 petitions to OP in preparation of Division 8 opening up at the end of the fiscal year. For unknown reasons, end of Sep came and went and Division 8 never opened up. But USCIS continued to send petitions to an office that was not operational.

Once they realised that OP was a no-go in October 2013, that's when they started sending new petitions to the Nebraska Service Center. Since October, I have not seen any members with an NOA1 from OP.

The reason why transfers are all coming out of NBC OP, isnt because they do the clerical work for pre-transfers. Its because mine and yours and everyone else's files up till Sep 2013 are literally sitting in OP waiting to be transferred.

Nope, there does seem to be stall in transfers, hopefully next week we can see some movement :)
