A little off topic here, but since there are so many Indians I thought I would throw this out there. Hubby doesn't have a birth certificate, it seems it gets turned into the school when he started in Bhopal and from then on he is supposed to use his school record as proof for date of birth?

What do we do then for NVC to submit for birth certificate when he doesn't physically have one and doesn't know any way of getting a "certified copy"?

BIRTH CERTIFICATE: Original and photocopy. Each applicant must submit an original and a clear photocopy of his/her birth certificate. The certificate should include the applicant’s name, date and place of birth, the names of both parents, and the seal of the issuing office, i.e., the municipal authorities. If your name is not mentioned in the birth certificate and if any details are missing in the birth certificate or if there is a discrepancy regarding your date of birth or name, submit the certificate along with secondary evidence.
Secondary evidence can be a baptismal certificate, an adoption decree, a school record, a notarized affidavit from a close relative, a neighbor or friend who was present at the time of your birth on the appropriate stamp paper, which must be sworn before a First Class Magistrate. The person making this affidavit must state how he/she knows your family and how he/she knows the facts of your birth. Secondary evidence must have your name, date and place of birth; names of both parents; and the seal of the issuing office. If your birth was not recorded, please submit a “no record of birth registration” letter from the relevant municipality along with secondary evidence and if your birth record has been destroyed or the municipality authorities will not issue one, submit a letter from the municipality stating so along with secondary evidence.

10th class (sophomore year) certificate is a very important document in India and that is used to prove Father's name, Mother's name, and date of birth etc in the absence of other docs and is totally acceptable. Usually that can be submitted locally to get one issued from the local muncipality. That can take anywhere from 3 days to a month. Ideally, regardless it would be best to obtain one. Also, Aadhar card, Voters ID/Pan card one or more of those are needed to obtain birth certificate and proof of address. They are converting to paperless on records after 1989 and is a requirement with no exception after that.

On February 12, 2014, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

yeah we have secondary evidence but no birth certificate at all to even submit. I guess we have to plan a trip back to Bhopal to see what can be done

is this the RFE? I guess you won't really know what needs to be submitted until you get the letter in the mail.

With my research and reading bunch of threads this is what I have usually seen:

- Corrections or missing items on any of the forms or submissions

- Prove US citizenship

- Prove bona fides of the marriage with additional evidence

I am not sure if you can call ahead and find out from tier-2 what exactly they are asking for. Might be worth a shot, but you should get a mail soon with the details.

Generally this is good news, your approval will follow shortly after you resubmit what they are asking for.

is this the RFE? I guess you won't really know what needs to be submitted until you get the letter in the mail.

If you are planning on getting birth certificate issued. You can hire agents usually and may not even have to go there. they can expedite and will organize the docs for you as well. As long as you have those secondary required docs. In the long run, best to have it anyway. Good luck.
