hi, i was wondering if anyone knew the answer to this- i am filing taxes for the first time as a married USC but hubsters in Scotland and has no social security- do i even say i am married on the form? it is asking for his SS when i say i am married. mmm

Yes, you need to file as married. You can get him a tax ID number (ITIN) if you want to file jointly, but that process is kind of a beast. Easiest way to go is "married filing separately" -- you'll need to print your return and put "NRA" in the spouse's SSN field to indicate he's a non-resident alien. You have to physically mail in your return if you go this route.

Also worth noting, if you have dependents you may be eligible to file under Head of Household.

I filed taxes with my wife last year as she is from Nevada which has a law that you have to file jointly.

It might be an idea to check the state filing requirements for married couples.

As BOS_LHR if you have the option to file separately do it the ITIN process is a pain my wife only recieved her tax return in November because of it!

for turbo tax you have to put in a "dummy" SSN then when you print white it out and write in NRA. Thats what I read when I searched their help forums on Turbotax and thats what I did to print mine

thanks everyone! Great tip about dummy ss.

I guess I don't mind waiting for my check.. I would rather have the taxes completed without having to apply for a tax number for him.. just in case we get approved soon! I have asked our lawyer too just to see what they say- asking them questions makes me feel better about wasting money on lawyers, as i am sure if i had found this site we could of done it ourselves.

I used TurboTax for my returns last week and you don't have to put in the dummy SSN, it'll let you complete and print your return while leaving that field blank. It'll just keep notifying you that you've left something empty and should go back to review. I can't wait to be able to file online again next year laughing.gif

also are you folks taking the election to file as MFJ and complete the W7 and write a letter signed by both parties to treat the beneficiary like they are a US resident, and once you do that, if you need the requirements you can either run your taxes to have foreign income exclusion or take a foreign tax credit, spedially if you are transferring money in/out of retirement accounts, etc. quite tricky, just be sure to consult with someone who knows the rules of but the US (obviously) and also the foreign country regarding tax implications and whatnot.
