hi! just a little help and question, i am from philippines and my husband is a green card holder, meaning not yet a citizen, can I file a k3 visa even though he is only a green card holder? your ideas are great help! thank you

No. K3 is already obsolete and it was only meant for spouses of US citizens.

Your husband will file i-130 for you. You will be under the F2A category (Spouse of Lawful Permanent Resident).

USCIS especially CSC is moving fast now. April 2013 F2A filers have already received NOA2 approval.

what do you mean F2A visa? how long it will take?

You belong to the F2A category (Spouse of a Lawful Permanent Resident).

How long it will take will depend on the upcoming Visa Bulletins. But normally it will take 2-3 years.

what do you mean receipt number of what?

I'm not sure what your lawyer is saying. You need to clarify that with him.

USCIS receipt number can be found on the i-797c Notice of Action form. USCIS mails it to the petitioner after they have accepted the i-130. Go ask your husband.

Notice of Action 1 (NOA1) is simply a notice that they received your I-130 application. Once your I-130 application is approved they will send you NOA2 ( approval notice of action).

Tutz01, your lawyer could be right. Since there are fewer applicants under the F2A category these days, more VISAS are available. Therefore, the wait time should be considerably shorter. Some petitions are being approved within 2 months whereas it used to take 2 years. ~~~~
