extension for an approved k1 petition?

so we had an approved petition dated april 24, 2013 and the 4 month approval period is up till aug. 26, 2013. problem is me and my fiance had a falling out as in break up but i did not cancel or withdraw the petition. we finally fixed things up around july of this year, but he was still undecided whether to resume our plans or not. finally today he made up his mind and said we'll go with our former plans. problem is i haven't started any paperwork for the next phase of the journey which is for the medical exam and interview phase coz he seemed undecided and on my part, i was a bit emotional and heartbroken to even focus on our petition. is there a way to apply for the extension of this petition or should i just withdraw and start all over again? i'm at a loss on what to do at this point and i know i had a fault in this! i need some suggestions or tips. thank you all in advance.

Please don't worry. The U.S. Embassy Manila will extend the petition for four more months. To extend your petition, your fiancé should email the Embassy and request an extension. The Embassy routinely grants extensions.

You can extend the petition validity for up to a year, 4 months at a time, simply contact the embassy to request this. Do you have the MNL#

I have done this. I emailed the embassy and was told in a reply that as long as we are both still free to marry and intend to, they will automatically extend the petition for another 4 months when we go in for the interview. Sounded kind of odd, but they restated the same thing when I asked if there was anything I needed to do before the petition expires and they said no. If you email them, let me know if you are told the same thing.

my thanks to all for the helpful tips. i emailed the Manila embassy this Saturday via their IVManila email address. Being a holiday and a weekend back in PI i would not expect a reply till Monday, when hopefully they will be able to read my email. And have a detailed response to my request in about 7 days. Will they send another notice to my fiance and to me as to a new priority date? i will definitely post any updates as soon as i hear from USEM. God bless!

Their 2 replies to me were pretty quick, so they should reply by Monday or Tuesday. There will be no new priority date, since nothing is done until the interview. This is why I was initially confused and asked them if there is anything I need to do before the interview.

This was their first reply to me when I asked about extending the petition:

We wish to assure you that while an approved fiancé(e) (K1) nonimmigrant visa petition is originally valid for four (4) months from the date of its approval, it may be revalidated by a consular officer for an additional four months. This revalidation is routine as long as the petitioner and beneficiary remain legally free to marry and plan to do so within 90 days after the beneficiary enters the United States in K1 status. The fiancée visa petition will be revalidated by a consular officer when the applicant comes in for a visa interview and submits a formal visa application.

I asked if there was anything I needed to do before the interview, or if it was past the 4 month period before we made an appointment, and they replied:

The applicant will still be able to schedule a visa interview appointment after the initial 4-month time frame. As indicated in our previous reply, the fiancée visa petition will be revalidated by a consular officer when the applicant comes in for a visa interview and submits a formal visa application.

No, you can reschedule the interview and delay the medical and can also delay or extend the visa. I'd suggest you guys make up yours minds if you are really serious or not. If not, then cancel all.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

this was the reply given to me by the US embassy when i emailed them that i wanted to apply for an extension for the approved fiance visa petition:


what should i do next - just schedule the medical exam and interview this month? but what if there's no slot - file it next month and it will still be ok anyway? i filed the petition in oct.2012 and got the NOA 2 april 24, 2013. it expires on aug. 26, 2013... thanks for the input.




As you are aware, an approved fiancée (K1) nonimmigrant visa petition is only valid for four months from the date of its approval. Consular officers may revalidate the petition several times. Each revalidation is good for an additional four months.



The petition is routinely revalidated provided the officer concludes that the petitioner and the beneficiary remain legally free to marry, and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States.



However, if the officer is not convinced that the U.S. citizen petitioner intends to marry the beneficiary, including instances where no action has been taken on the application for a year (i.e., a visa interview for the applicant and submission of required documentation), the petition may be returned to the approving U.S. Citizenship and Immigration Services office.
