So I've read so much conflicting information (Not necessarily from here) on when/if/how a fiance of a green card applicant can work?

Here's the details:

1) Current Canadian Fiance has been offered a permanent position at a US California based company that are sponsoring her and has just started the green card process.

2) We will be married in the coming weeks (been together 9 years).

3) I do not have a job sponsorship offer, or any work possibilities atm

4) Can I seek employment as she goes through this multi-year process? Or am I to twiddle my thumbs for years, and not contribute to our savings?

Any direction would be greatly appreciated. :)

Thanks!

Once you are married you can get a dependent visa. What visa is she getting? An H1B? Once you know that you can see if the dependent version can apply for a work permit.

First she gets a visa, not the greencard yet.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

+1 If it's a H1B, you need to talk to the employers who are sponsoring that visa, and they should help sort out your visa to go with (I believe it's the H4). H4s can't work.

back to post #1.

Please elucidate on what item #1 actually is, from your list. Thanks !

[i ask, because a company sponsering a human and k-1 visa chaser are many times not in the same universe]

aha - I think I got it - BOTH of you are CANADIEN !

----

If you'd like to work, as well - you should look at TN-1 visa, nowish.

So quick update...Don't know if this makes sense, but apparently her future employer is applying directly for a EAC employment auth cert???

Does this make sense? Said no H1B required!

No, it doesn't. But there is too much missing here to try to figure out what that is. Perhaps she is getting a TN? TN cannot lead to a Greencard. Perhaps you are confused about what a Greencard is?
