Hello,

I Just have a few questions about the K-1 visa:

While she is here on the K-1visa, is she able to work over here without having to get sponsored by a company?

After my fiancé and I get married on the K-1 visa, how long until she will get her green card and be able to work?

Any help is greatly appreciated!

No on the work with K-1. On the second question, once you marry, you file for AOS-adjustment of status, which includes the GC, an advance parole (for travel) and a work authorization (EAD). Usually the EAD approval is in about 3 months, GC would take another 2-3 months. SHe can work with the EAD.

re: company sponsership - uhm, no, no no.

re: working - can work when have EAD or greencard in hand.

Hi Justin,

Once your fiancee arrives in the U.S. on the K-1, you're required to get married within 90 days. She cannot work in this period. After you get married, apply for AOS on Form I-485 (along with EAD on Form I-765 and Advance Parole on Form I-131). She is only authorized to work once Form I-765 is approved (usually takes a few months after filing).
