Aaah I'm officially going bonkers!!

My fiancé is currently preparing the affidavit of support. We're good with the I-134. But now we have questions about the tax returns. My fiancé always had all his tax returns in a folder. So is that good enough to send to me? Or does he need documents that are signed by an IRS officer? I'm really confused. Then again, if what he has is ok, can he also send me just a copy or do I need the actual papers he has? He's not fully comfortable with giving these papers out his hands. So can he only send me a copy or should he send originals and keep copies for himself? Will they keep originals or hand them back at the interview?

I'm at a point where I'm overthinking every breathe we take in this process. So stressful :(

you don't need tax return information for the I-134 form...That's with the I-864 form when you apply for the Adjustment of Status....

In any case, for whenever you need the tax information: it is best if your husband orders tax return transcripts from the IRS (instead of providing the tax returns themselves). These can be ordered online, are free, and arrive in about a week. They are a summary of each line of the tax return.

It is better to order the tax transcript online from IRS and It would take 5-7 days to arrive to your mailbox. Note that the signature in tax transcript is somewhat electronic signature. You can also use tax return 1040 page 20-21 but I would recommend tax transcript over 1040 because tax transcript is from IRS which means you did file. In other hands, 1040 does not indicate you did file , it just indicates that you did fill out the tax form but do not show you sent the tax form 1040 to IRS.

So we don't even need it?? My fiancé makes several thousands more than the annual required income. Almost twice as much. We don't need tax returns then? Just I-134, pay stubs and an employment letter?

Just order the tax transcripts from IRS. It is better to have it with you rather than RFE for it. Something is always better than nothing, right? It is not difficult or heavy to have it with you.

Just order the tax transcripts from IRS. It is better to have it with you rather than RFE for it. Something is always better than nothing, right? It is not difficult or heavy to have it with you.

I totally agree with you. That's why my first question was if what we have (w2's plus 1040) already is enough or if we actually HAVE TO order something from IRS. Which we would dislike cause my fiancé is ready to send me the papers and waiting for mail from IRS is gonna be a delay.

But I definitely would send it if what we have is ok. In this case I believe 'the more, the better'

They get drowned in relationship evidence too!

Im prepared everything I can to prevent RFE. I have tax transcripts and tax 1040 with her to prevent all the costs. It is my suggestions that You send the tax 1040 just for now. In the meantime, you can order the tax transcripts and bring to interview with you later. However, I think either 1040 or tax transcript is enough.

for the 1-134 you need the most recent tax return or 1040.some pay stubs a letter from your employer with company letter head stating how much you earn and how long you have been there and your job status-. maybe your banking statements.good luck

It is not that black and white. It will depend on the consulate. Always follow the instructions from your specific consulate and supply what they ask for, no matter what the I-134 instructions state. It is also only supposed to be 100% of the poverty level for an I-134 but many consulates follow the I-864 guidelines and expect to see your income at 125% even when using the I-134 for the K-1.

What does your consulate ask for? If their instructions state nothing about what supporting financial documents they want to see, then be safe and provide the most recent tax return transcript along with the letter from the employer and/or recent pay stubs.

I'm more than willing to provide the tax information. My original question was just if I need transcripts or if we can hand in the 1040 with the W2's that we have. We don't wanna loose time having to order something from IRS. And if we can send the 1040 and W2 and we submit originals do we get them back or are they allowed to keep them?

You can also walk into an IRS office and get the transcripts the same day. If you do not get the IRS transcripts, then a copy of the complete return with all forms, schedules, W-2s and/or 1099s can be used. Just use copies, not the original tax documents.

Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864?

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.
