Denied I-129f even though I withdrew first application

I wish I could post the exact PDF of their denial letter so all could see it.

I am seeking the RFE letter, sent from USCIS to your attorney.

Why? IMO, the disconnect is between 'what you wrote' and 'what the RFE was asking for'.

Can't do further triage without knowing the contents of that RFE.

Lawyer never sent me the RFE. We just told me to write a letter explaining why the old relationship didn't work out. He didn't mention anything about a waiver. I will see if I can dig up the form. Regardless, they failed me because I didn't specifically ask for a waiver----how insane is that!?

The only thing I will miss about the USA is decent ice cream!

dude you sound really bitter, time will heal, in love you must trust and trust blindly, if you dont trust blindly and with your entire heart, you are just merly compromising and coasting,to me thats not love, it is only getting by. hey you got suckered, big deal. if a Man gets punched, he gets right back up and looks the guy in the face who punches him, and you keep getting punched and keep getting up,time after time... untill you can not get up.....that my friend is a man

please reconsider badmouthing the military,,,,they protect your right to bad mouth the flag and country...and men and women die EVERYDAY so you have the right to run your mouth...that is bravery... what i read is self loathing pitty party,,,suck it up and go on,,learn from your mistakes, if a mistake does not cost you, then you probally did not learn from it.....go live in Vietnam and bad mouth their flag and their military....see how that goes.

I'm sorry if it came across that I was bad mouthing the United States. I don't know what I said that specifically denigrated the military, but my intention was never to criticize soldiers----just the politicians that wield our armed forces like the police force for the planet. Maybe we should mind our own country first, instead of putting our noses in everyone else's business. I do appreciate the freedom to say what I want and I know that is what makes the USA great.

I agree about getting up after being punched. Having been in my fair share of fights, I agree the true test is to get up and move on and figure out what to do. Sorry if I came across as a whiner---its just been an exhausting couple of years.

I took the advice of some other members of this forum and consulted with Mark Ellis. He wants $1250 to represent, and that doesn't cover the cost of reapplication fees and the sort. Plus he advises getting married in Vietnam and applying for a CR-1, which is good advice, but I have to head back to the USA to earn enough money to be able to afford a wedding, application and attorney fees. All of this plus plane fare is somewhere around $7000-$8000? I don't care about the money, but it's the annoying time separated from my fiancé that sucks. I could achieve a lot more with her helping run the business and handle the receipts/phone than I can do home alone. That's neither here nor there.

Thanks to all for the advice. I'll update you as I get things together. I will have a dinh hon in Hue on September 25th, head back to earn cash and wrap up my USA obligations, and return here in February.

Ellis' fee is fair. Perhaps you can pay as you go for specific questions and pay less and do most yourself.

I hear you on the 'it sucks" part. I am also re filing and it is a mind boggling undertaking.

I wish you both the best and with your great attitude you will make it just fine.

Something else to consider, if you marry and file a CR1 you will save a thousand on AOS and she can work

right away instead of waiting for the work permit.

You can keep the wedding very simple.

I know...pros and cons all around.

Visa Received : Nov. 3 , 2014 VISA IN HAND.

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
