The Departure Penalty

Why won't illegal aliens just leave? Were you aware of the Departure Penalties described in INA 212(a)(9)(B) and (9)©? These regulations punish illegal aliens who decide to 'come clean' and leave the country. No wonder the illegal alien problem is so bad when we punish illegal aliens for leaving! These regulations are ridiculous. We need to get rid of these Departure Penalties if we are to ever resolve our immigration issues.

but, i do wonder, if they werent concerned with the penalties in the US when they entered illegally, why would penalties for leaving bother them?

I think, technically speaking, there are no penalties for entering. However, if you're in a situation where you might want to leave for whatever reason and come back at a later time (or just make a break and leave altogether, then you are actually penalized at that point).

Surely whoever came illegally would think that somewhere down the line, there will be consequence of doing it?

Or, everybody who came here illegally never thought that it is wrong to do it ?

I can't speak for everybody, but this kind of relates to what I posted on another thread a couple days ago (that nobody noticed or responded to). When I asked my husband (previously illegal) why he decided to break the law and come to the US this is what he told me (and I posted in his own words):

Ignorance of the law is no excuse. They know exactly what they are doing BTW. It's not like they just wake up in the USA illegally.

that's like saying someone who steals a car then brings it back - "im sorry... now since i brought it back and came clean - nothing should happen to me!" (or maybe just a tap on the wrist)

You'll be surprised how many people still believe that America is the land of immigrants

and that everyone's welcome if you just make it across the border.
