AOS Letter received about Delay

Hello everyone,

My husband and I filed my AOS in April and I had my biometrics app May 17th, I have already received my EAD/AP but we're waiting on an interview app or approval.

Well today there was a letter from USCIS and I was all excited it would finally move forward. But the letter just states "Notice of Potential Interview Waiver Case" and that we might qualify for that but that they still might determine later we need an interview. BUT now the bummer is, it states they're so busy that they anticipate a delay and that they estimate we will get a notice in 6 MONTHS! Not that I desparetly need the Green Card since I have my EAD however I was ready for a break from USCIS and I feel like if they have time to review my papers, send the EAD and then send this note...why not just work the case...

Has anyone else gotten this and did it really take 6 months?

Good for you. In my case I didn't get anything from USCIS regarding my AOS application. No letter of that kind. And imagine I applied February of this year.

I think that's a good sign that your case has been viewed by them.Just wait patiently.

Wow...February?

I know patience is the key...but the EAD is only for a year and my drivers license as well as long as I don't have my green card. So I just hope I'll get if before they expire.

I do agree however its a good sign they touched my application. I just don't get why they review it, decide it might be good for a Interview Waiver, take the time to send the letter and then put it back in the pile....waste of time in my opinion.

Got nothing either, filed in early March.

I do know two other members on here who are going through the same local office as me (OKC) and who filed in December/January. They got interview letters in July, after 8 months ... And then all of a sudden their interviews were cancelled a couple of days before the interview! They were told their cases were being re-evaluated, and that they might qualify for interview waivers (duh...). They were also told that if it is determined they will need an interview, they will receive another note in the mail sometime in the future. I am very nervous about all of this. I really need a break from USCIS.

I'm with you HK12, I really want a break! Starting a new life, career etc is work enough.

I couldn't believe getting an interview and then having it cancelled all of the sudden?! Terrible!

I don't get why this process now starts taking forever!

I haven't gotten anything either. I had a letter from USCIS in the mail yesterday but it was my biometrics appointment letter.

I am wondering why some of us receive this letter and some other don't...

K1 Journey:

NOA1: 08/21/2012 (CSC)

NOA2: 04/24/2013 (8 months ClockWatch2.gif )

NVC received: 05/02/2013

NVC sent to Embassy: 05/06/2013 (only took 4 days !!)

Packet 3 received: 06/01/2013 (our son's 2nd birthday !!).Packet 3 response leaving in the mail on the next business day (06/04)

Medical: 06/11/2013

Interview: 06/18/2013. No packet 4 received, interview notice given on the phone the day before.

APPROVED !!

POE Chicago: 07/05/2013

AOS (EAD/AP) Journey:

NOA1: 07/30/2013

Biometrics: 09/09/2013

EAD/AP: 10/09/2013

Received a "potential interview waiver case" letter on 11/23/13.

This is NOT the norm and in fact your GC has an error. I remember discussing this at the time. I'm surprised it still hasn't been caught. If your wife files for N-400 (which means she'll lose her chinese citizenship) it'll be interesting to see what happens. It's so screwy. But we've discussed it before.

To anyone else reading - this is NOT what is supposed to happen. LPR status is based on the date you're APPROVED. If something like this happens you're supposed to file an I-90 (which I believe bigdog did) and get the card corrected. For some bizarro reason they never fixed his wife's card.. come N-400 it could create some serious problems (ROCing before they were supposed to etc etc).

Don't feel so bad, people in my category (filed I-130 with wife in her home country) are getting the notices as well. The whole system seems to be imploding, which is weird since they are self sustained by the fees that we send in and wait over a year for service. Incredible. Being separated with our loved ones is the worst!! Good luck to all, thanks for letting me vent.
