James, what was the first reason for denial on the past petition? I see the new petition is already on it's way or in Manila by now.

NVC can tell you for free if or not you need to cancel the previous petition.

This is not your first time dealing with these matters. Be sure she knows all the details of past relationships for the interview.

12/17/10 ....USCIS received the Filed I-129F for K1-visa
12/21/10 ....Received hard copy,NOA1
5/25/11.......Received RFE
6/09/11.......NOA2 approved
12/07/11.....Visa fee paid at BPI

6/11/13.......2nd visa fee payment
7/10-11/13.. Medical Exam completed@St.Lukes Clinic
1/15-16/14.. 2nd Medical exam updated
1/21/14...... k1 interview-Visa Approved
.....................................................................
8/29/14...... Submitted AOS application
10/03/14.....Biometrics
01/07/15.....Received my EAD card

01/31/15..... I got my SSN from the mail

04/20/15......AOS Interview - Approved :star:

4/24/15 .......Got the Driving Permit Card

4/30/15 .......Green Card Received :) (Exp.4/20/17)

Hello Tim/Mav Thank you for the response.

Actually this is the 2nd petition for my fiance. She has been petitioned before but it got denied in USCIS because of her Ex bf background. the denial was about 2 year and 5 months ago. She is confused if we need to cancel the denied petition before here interview schedule.

According to the Denial Letter:

The decision will become final unless you appeal it by filing EOT-29. The decision is final if your appeal is not received within the time allowed which is 30 days.

I hope someone also can answer me with the same situation.

Just a quick question. DO we need to cancel denied petition before filing a new K1 with a different fiance? Right now my new K1 petition have been approved and I am just worried about the interview.

No you do not need to cancel the old petition - if it was DENIED. It's dead... finished.

Like said by others your fiancée needs to be very honest about the old petition when at the interview IF asked questions about it.

No you do not need to cancel the old petition - if it was DENIED. It's dead... finished.

yes your right she was petitioned 2.5 years ago and yes she is honest about it. In fact she wrote an attachment letter of what happened why they split up with the first petitioner.
