Bad news and more confusion. My fiancee made the journey to the consulate at the capital today. When she arrived there was no letter or any other documentation waiting for her. Things went from bad to worse, the person told her that her visa was refused because of her medical and she could reapply again in one year.

We have no idea what could be the issue with her medical and they did not provide any further explanation.

I called the DOS visa line and they only can see that the case is still in process.

If we can't get a copy of the medical results, I don't know how to address this.

Can you call the hospital to find out the issue? Not sure if they have HIPPA laws over there.

The first thing to do is to get hold of the copy of her medical. They did say she can reapply in one year. The only thing I can think of is has she been in contact with anyone with TB cos the one year thing makes me think that it may be the X-ray that's the problem. Treatment for TB is usually about a year. Just a theory not saying that is the case here. It's best you get hold of the medical copy. Best of luck with it and I hope it's nothing serious.

2/7/2014 (day11) noa1 hard copy arrived in the mail for I-485 I-131 I-765

2/14/2014 (day18) biometric appt letter arrived in the mail. Appt schedualled for 2/26/2014 11.00am.

2/18/2014 (day 22) biometrics successful walkin.

4/01/2014 faxed expedite supporting documents to number on letter sent to me. Waiting waiting waiting

4/03/2014 (68 days) EAD and AP approved text message sent status post decision. Hooray !!!

4/7/2014 (72 days ) status change to card in production for EAD.

4/10/2014 ( 75 days) status changed after calling uscis regarding urgency of EAD. Also usps tracking number at 20.580pm

Thanks all for the support and comments so far. After talking with my fiancee again later today when she was calmer I have a little bit more understanding. The person said that the medical was due to her health, whatever that means and I thought they had told her reapply but I believe they told the the case was still open and in-process but she needs to wait a year and get a new medical, not reapply.

I've sent more questions to the consulate via e-mail and asked for a copy of the medical report and clarification. If she has health issues we need to know and get them taken care of.

Nurseling, I did think about TB due to the one year thing but she was recently checked for that and was OK.

Regarding the drugs I thought that was an automatic out, I hadn't come across anything about a waiting period for that, however during the exam she did disclose previous cannabis use. Harpa can you point me to information regarding how a delay is determined?

I can only speculate and guess without the results and so far the embassy is telling us. Anyone know how we can get a hold of her medical records short of a freedom of information request?? We tried the clinic already but so far we are getting a bureaucratic run around.

You have your answer. By admitting to previous drug use (even marijuana) this makes her fail the medical, and she must reapply again in a year. They will probably ask for periodic testing throughout that year, too.

Yes. Previous use is an automatic 1 year denial. They will ask her to periodically test I believe 4 times during the next year. IF all of those are clean, she will be given the opportunity to redo the medical exam.

That is the hardest thing. Even if they admit the use was YEARS ago, they will still give her a 1 year waiting denial.

I'm so sorry to hear this! :( Thoughts and well wishes go out to you both!
