I have everything in order except maybe enough proof of a bona fide relationship (I have a lease and some photos) hopefully if they want more evidence they will ask for it in the second interview. They wouldn't turn me away because of this right? Anyway I am writing to see if there have been any recent changes that I should know about? The filing fee is still $420 right? Also they asked for an alien filing number on the I-130 application that I have no idea what that is. I figured they would give that to us later right? Thanks so much for the help all of you here are so wonderful and have been such a tremendous support group through all of this! heart.gif So much love! Wish me luck! I will update my timeline ASAP.

I don't know if it's different for DCF but my fiance and I had our interview yesterday at the Lima embassy, we had a whole binder full of relationship evidence and all they really wanted to see were the photos. They also took and kept our skype logs, phone bills, and notarized letters from friends and family...but since you two live together the skype and phone really wouldn't apply... in summary you should be good!! Good luck!

Thanks! Yea we ha e always lived together so there is no phone bill or skype evidence. I have lived in Peru since the very beginning of our relationship. I have stayed here for so long for him, so hopefully they will understand. Did you file DCF? I am getting ready to file the first round application tomorrow. Then if everything is approved they will ask for more info right? Like a sponsor financially and medical records, and then finally an interview right? Congrats! I have heard good things about the embassy I hope they're true.....I don't live in Lima so I have to travel there. I hope they don't make it difficult for me......

We went the fiance visa route so we didn't do DCF... but in our case we didn't have to give the affidavit of support for the financial sponsor until the actual interview, the medical exam he did about a month before the interview and had to pick up the results a week later to bring with us to the embassy. I know the medical is the same for the spousal visa but i'm not sure about the sponsor. The embassy was great though, we were really nervous before our interview but it went very smoothly, everyone was very friendly! You'll have to go to Lima to have the medical done and for the interview of course but other than that it shouldn't be a problem... good luck! Feel free to message me cualquier cosa!

Hey! I dropped off the application today and it was so easy! The woman barely even looked at my packet. Is this normal? She says they will send us a letter between 3 weeks and 3 months telling us what to do next....does anyone know what the next steps are so we can start them now?

Hi all. I am getting ready to apply for DCF I-130 from overseas. I am here visiting my fiance for 6 months now and will meet the residency requirement. Does anyone know if dual citizens require Certificate of Residence or a Foreigners' Permit to Stay?

Thanks

What? Where? Filing from overseas? Who has dual residency and to what countries?

Very happy to hear you are on your way with this crazy process.

I would like to DCF in Italy. I am USA and EU dual citizen. My fiancee is Italian. I am here visiting here for 6 months now and we are deciding to move forward and file I-130 after we marry here this Fall.

I think I have the right information. I spoke to an immigration attorney yesterday who told me "embassies stopped accepting and adjudicating visa petitions several years ago". I told him I think he needs to brush up a bit!!

Immigration attorneys appear to be completely unversed in DCF, I assume because it varies a lot by country.

He's partially right in that many embassies did close their USCIS units meaning DCF available countries have reduced significantly.

Hi,

You should look up the requirements for DCF. Most counties will not let you apply on a tourist visa. You have to be living in your country with another visa. Therefore you can't live somewhere for 6 months to meet the 6 month requirement if you arrive on a tourist visa.

But, you should call the Embassy and ask what they advise.

bellavita38 isn't a tourist - they're dual-nationality as an EU national - so is luckily free to live there as long as they like. bellavita38 does need to go and get a certificate of residence, however, as they've been there more than 3 months (but we covered that in a different thread).

It's true that most consulates will not accept those on tourist visas to do DCF (as that's obviously open for abuse). Generally, you need to be there on a family, work or student visa (and even then, some consulates won't take student visas - London didn't until recently, for example).

I'm trying to figure all odf the specifics out myself so no worries. Seems silly to wait 6 months for the residency requirement when i am considered a legal national here.

To be honest it will take much longer for my home state to send over a certificate of marital status than to fill out the I-130!!!

thanks for all your help everyone!!

Yeah it DOES vary from country to country. I have been living in Peru for over 2.5 years on a tourist visa but the US Embassy doesn't care at all. They still accepted me and didn't have a problem for me to file DCF. Bellavita shouldn't have a problem since he is living in Italy with dual citizenship.

Lost at sea- quick one, when did London start accepting student visas and how do you know that..... they seem really shady about it, their response to me was

"she needs to be in the UK for 6 months on a "valid entry clearance" they didn't specify the visa type requirement
