Can a green card holder file a petition to his family under f2a even if his under removal prodeesings?

Help! Guys, my husband wants to petition us under f2a but his under removal proceedings at the moment. Is it possible that he can petition us? If yes, how? His green card was surrendered at the immigration. Need your opinions regarding this. Thanks

I don't see how he can file i-130 for you because one of the initial requirements is submitting a photocopy of the front and back of the petitioner's valid green card.

Interesting. He is still technically a greencard holder so he may be able to, but my instinct say no because he doesn't have his greencard and would need a copy o it. Additionally, they would likely hold the petition until his own case is resolved.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
