Hey VJ friends, its been a while since i been on here, if any of you remember me, i was an October 2012 filer for AOS, since i received my GC on valentines day, i've been pretty busy. I'm now a Sailor in the US Navy and i'm also a US Citizen. I'm very happy everything that everything worked out for me thus far and i'm very proud of be a Citizen of this great country and also serve in the military..

On another note, as the topic said i'm looking to sponsor my mom and my brother, the process involving my mom i know most of what needs to be done (since i just went throught it not too long ago) but i'm not sure how to go about doing it for my brother. Do i mail everything together (i-130, i-485, i-693, i-864, G-325A...) like i would with my moms case or is it done separately.. Thanks in advance for the advice..smile.png

hi,

you can only file the i130, since it takes around 12 years of waiting

is your mom in the US? how did she enter the country? if she is in your country you would only file the i130 for your mom and an i130 for your brother, they are separate petitions. also, if your brother Is in the US he cannot adjust status here, unless the laws change in that very long period of waiting.

Follow the guide: http://www.visajourney.com/forums/index.php?autocom=custom&page=i130guide2 but obviously substitute "parent" for "spouse" (both are immediate relatives of a US citizen), provided your mother entered the US legally.

For your brother, you could file an I-130 under the F4 preference (sibling of a US citizen); the wait time would be approximately twelve years.

Alternatively, once your mother has her green card she could file an I-130 under the F2B preference (unmarried child of a permanent resident that is over 21) and this would instead make it a ~six year wait, shaving six years off the process. If your brother was under 21 he would instead be petitioned under the F2A category, which is actually current at the moment (no wait time).

My mom is here and she came on a tourist visa and overstayed, my brother isn't here.. So i'm pretty sure my moms is gonna be almost identical to my case when i did it last year excluding the supporting evidence for marriage, but i read that for my brothers i just have to file the i-130 first and then they'll grant him a visa to come here and then be adjusted..
