I am sending off my I-130 and I-485 together for my AOS.. I am sending them over 2 weeks before my visa waiver ESTA runs out.. but I was wondering how long it takes the USCIS to respond saying they have my forms.. and what happens if they don't reply by the time it is up? even though I have sent it before my time runs out... I just don't want any trouble.

also we are hoping to send it express from texas to chicago. we estimate a few days for delivery.

Hi. I had the same issue my husband and I submitted the petitions with like 3 days left on my vw ESTA. I mailed them on a Friday. The wrote to me the following week. I was nervous I didn't want to get into trouble either but from what I've found out through this forum if your spouse is a US citizen then any overstay is forgiven.

If you file your AOS papers with G-1145/E-notification of Application Acceptance, you will receive a notification via e-mail and/or text within 2-3 days from receipt of your packet. The notification usually indicates a receipt number and instructions on how to obtain case status information. You can register online to monitor case progress as soon as you get your receipt number(s).

In my experience, the NOA was sent two days after my papers were received. I sent the packet via Fedex overnight mail on a monday and it arrived 10:00 a.m. the morning after, and notification was sent via text and e-mail on thursday. Notification in the mail arrived tuesday the following week with the Bio appointment arriving within the same week.

I received my notice letter 2 weeks after I sent my package in.

AoS from F-1

06/22/13 - Mailed I-130/I-485

06/26/13 - Package delivered to Chicago Lockbox

07/01/13 - Received email of acceptance of application

07/02/13 - USCIS returned Photos in package

07/03/13 - Checks cashed

07/06/13 - Received mail of I-797 Notice of Action Letters

07/12/13 - Received mail of Biometric appointment

07/19/13 - Successful walk in Biometric done!

08/04/13 - Received text & email about Interview date for Aug. 1?????

08/06/13 - Received mail of Appointment Letter for an Interview that is Scheduled for Aug. 1??????

08/07/13 - Received text & email about case being in Interview scheduling phase (website took off Appointment date of Aug. 1)

08/12/13 - Received email about Interview date (no text message this time)

08/12/13 - Received mail of Appointment Letter for Interview Sept. 12

08/13/13 - Received phone call from USCIS office (around 7:30am) to see if I received the Appointment Letter yet.

09/12/13 - Interview officer said we were approved!!!!
