Line 22? I really dont have any idea about this. Does it say line 22? or something else? sorry to ask you that question.

When he tells you the number on line 22 of his most recent tax return, you'll know his NOW current income, not his interpretation of what it is. I have no clue where he got that number. When the time comes though, the most important number will come from line 22 of a tax return he has not yet filed.

Line 22 is numbered line 22 and labeled "total income". Ask the question and get the answer. Simple stuff. 1040 form, line 22.

He showed me his form 8879 right now, It say ADJUSTED GROSS INCOME and inside the parenthesis it says form 1040, line 38: form 1040A, LINE 22; form 1040EZ, line 4. I think this is what your talking about. It does say 19T plus.

Line 22 is numbered line 22 and labeled "total income". Ask the question and get the answer. Simple stuff. 1040 form, line 22.

He said that the only thing he have is his W2 and the form 8879, those were the only things that were given to him when he filed for his tax. So is he going to file for 1040?

pushbrk thank you so much! He was able to find his 1040 form. He was able to see the line 22 your talking about on it. "22 Combine the amounts in the far right column for lines 7 through 21. This is your total income " That's what it say.

What is the dollar figure on that line? If he is self employed, he may have both a plus (the W2 income) and another plus or minus from the Schedule C. Line 22 is the key.

it has 22T on it. I just checked the one on his line 22, like what you said. Are you talking about this "Business income or (loss). Attach Schedule C or C-EZ" what does that mean though? Does he have to attach something together with the form?

And yeah I do have a bit of confusion with our I-864, this is for our affidavit of support this is not part of my friend's issue. My husband when he filed his tax for 2012, because we just got married recently it was stated that he was single and since I'm not in the US just yet and haven't really went their so I dont have an SSN number. Do we have to do something for it? Like file a specific form? We are starting to prepare some stuff for the NVC stage.

If there is any amount listed in the section for business income, there is also a schedule C. Whomever did his taxes can provide a complete copy of his tax return. You still haven't told me what the number is on line 22.

When you arrive and have a social security number, your husband can file an amended return.

So basically it's ok for him to pass his I-864 together with the taxpapers even if his tax return form still says single?

If there is any amount listed in the section for business income, there is also a schedule C. Whomever did his taxes can provide a complete copy of his tax return. You still haven't told me what the number is on line 22.

The I-864 is not provided until a few weeks after the petition is approved, so about six to seven months after the petition is filed. You indicated the petition is not yet filed, so it will be after the end of this year.

What goes with the affidavit is described in the I-864 instructions. We're just discussing how he'll determine his current income. He'll also be stating his income from the last three years' tax returns. For a self employed person (even if both "employed" AND "self employed") "current income" is line 22 on a 1040 form. Employed people who are not also self employed are a different story.

I don't know how my friend is gonna deal with it right now, because they are planning to do the DCF. He said he will talk to a lawyer about it.

That's different. If DCF, it will be this tax return used for current income. Everything matters. It's a judgment call.
