I have the deferred act permit, my niece was born here in the usa, but lives in Mexico, she and her parents want her to come live with me in california, they can not even feed her right for the hard situation they live. she is ten years old, what type of paper work do I need to get her medical insurance and put her on school?

  1. Let her parents sign an official paper to authorize you to be her guardian. Then, you can make every legal decision for her on her parents' behalf. But I don't know what official paper they should sign. I guess they need to get it from Mexico authorities. Or, maybe, get it from the US Embassy or Consulate that has jurisdiction over them. It is easier for the government agencies in the US to recognize and accept documents that are produced at the US Embassy or Consulate.

She needs her US passport to enter the US.

You need legal paperwork from Mexico that appoints you as her guardian. You may want to work with a lawyer to make sure the paperwork will be honored in the US.

She will qualify for Medicare.

The guardianship paperwork will allow you to enroll her in school.
