Hi,

My Brother is sponsoring my Wife and his tax statements for the last 3 years show that he makes almost 3 times the income guideline requirement. Should he also include a letter from his bank or is this not necessary. If including a bank statement is the case- then what info should the letter include? I remember reading what the letter should include but once again I cant find the info again. Hoping someone could tell me if they might know this off the top of their head. Thats if the bank letter should even be included! Thanks Everyone-Gary

Aug-24-2006 - Back home to the U.S. Again. Leaving this time was by far worse than the last.

Oct-12-2006 - Email from USCIS - I129F transferred to California Service Center on Oct. 11th

Oct-18-2006 - Email from California saying they received my I-129F for processing

Nov-02-2006 - Email from CRIS(early afternoon) -I129F approved

Nov-02-2006 - Email from CRIS (late at night) - I130 approved

Nov-06-2006 - I129F and I130 NOA2 received in mail-Hooray!!!

ITR's and W-2's provided to back up the income, I don't think not having bank statement would be problem.

Do you know where you can get the I-134 notified or does this not have to be done?

AOS and EAD Timeline

First Application rejected due to them not receiving $70 for Biometrics, even though I had a receipt from them :-(

NOA1 - 10/01/2007

Biometrics - Middle of October, don't have exact date sorry

I-485 and I-765 Touched - 10/23/2007

EAD Approved - 10/27/2007

the I-134 has to be notarized. it can be done at any public notary in your county.

As long as income exceeds 125% poverty line then bank statement not a requirement.

The I-134 Affidavit of Support is required for returning residents (SB-1), fiancé(e)s or spouses of U.S. citizens (K1, K3), children of K1 and K3 applicants, spouses and children of LPRs, applicants with special immigrant status, and follow-to-join derivative family members of employment-based (E) applicants. A copy of the sponsor's most recent Federal income tax return (Form 1040) should accompany the I-134. Fax copies of the ITR are acceptable.

Thanks everyone-once again the forum pulls through. I also am going to check out the links that YuAndDan posted. What I am learning from the VJ members is that Manila tends to be more (lack for a better word) "strict" when it comes to affidavits,sponsors,etc..., I think the best thing we can do is go there well prepared and loaded with info. Keep the basics together for the interview and have the rest in another folder that can be easily presented to the interviewer if he/she is to ask for them. Thanks Again- Gary

YuAndDan-would you happen to know just what the bank statements should include. Is it the Banks president that writes the letter? And is it suppose to say my Brothers monthly deposits? I just cant remember. I know i read somewhere exactly what to do but you know me-I get a case of CRS going on and I just draw blank. Thanks- Gary

I use BankOfAmerica and they knew exactly what a sposor letter was, had a standard format for it and everything. Took me like 3 days to get it after I went to the bank and requested it. I'd advise it.

Bank of America here in Florida was useless - I finally had to get an assistant manager to hand type exactly what the instructions said.

No finger pointing, but where does this dis-information keep coming from ? It clearly states on this page:

No. The 125 percent minimum income requirement, the need for the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

K-1, k-2, k-3, k-4 applicants going thru Manila Embassy are required to provide most recent ITR and W-2. it's in packet 4 for Manila.

We had the bank letter in addition to the tax returns because the I-134 instructions had it as necessary. I thought it would be better to be prepared than have to wait on a bank letter, but in the end the consulate didn't ask for it. (Tried to give it to them but they only wanted the tax returns.)
