This might be a stipud question:

What kind of visa is a K1 Fiance?

Immigrant or NON Immigrant

The K-1 is a dual-purpose non-immigrant visa.

Overview: What Is a K-1 Visa?

The fiancé(e) K-1 nonimmigrant visa is for the foreign-citizen fiancé(e) of a United States (U.S.) citizen. The K-1 visa permits the foreign-citizen fiancé(e) to travel to the United States and marry his or her U.S. citizen sponsor within 90 days of arrival. The foreign-citizen will then apply for adjustment of status to a permanent resident (LPR) with the Department of Homeland Security’s (DHS) U.S. Citizenship and Immigration Services (USCIS). Because a fiancé(e) visa permits the holder to immigrate to the U.S. and marry a U.S. citizen shortly after arrival in the United States, the fiancé(e) must meet some of the requirements of an immigrant visa. Eligible children of K-1 visa applicants receive K-2 visas.

2013-08-23 (Day 11)- received hard copy in mail for Noa1 gc , Work permit

2013-08-30 (Day 18) Received Biometrics appointment letter in the mail.

2013-09-17 (Day 25) biometrics appointment day @2pm Detriot

2013-09-25 (Day 33) received text and email , I485 changed to testing and interview

2013-10-02 (Day 40) received text message and email @7am about my interview date

2013-10-04 (Day 42) Received hard copy interview letter in the mail

2013-10-10 (Day 48) Work permit Card in production

2013-10-16 (Day 54) 2nd Text and email @830am Work permit in Production

2013-10-21 (Day 59) text/email notice 10am . Work Permit sent

2013-10-21(Day 59)Text/ email @9pm received text with tracking number -2 day delievery

2013-10-24(Day 62) received my work permit in the mail.

2013-10-25 Filled for my Social Security number today

2013-11-05 (Day 74) Interview November 5th (1.40pm)...... APPROVED!! kicking.gif

2013-11-05(Day 74) Text and Email - Green card in Production @2.30pm

2013-11-05 (Day 74) Text and email @8.15pm Mailed notice that i am a registered permanent resident

2013-11-07 (Day 76) 2nd Text and email @11.30am - green card in production

2013-11-09 (Day 78) Welcome letter received - WELCOME TO THE UNITED STATES OF AMERICA!

2013-11-12 (Day 81) - Received text and email - Green card sent @1.15pm

2013-11-12 (Day 81) @9pm received text and email - with UPS tracking number - For Green card

As others have indicated, K-1 Visa is a nonimmigrant visa.

Here is the excerpt from your embassy visa info page (link above),

"After the USCIS office approves the petition, it sends the petition to National Visa Center for processing, which then sends it to the embassy or consulate where your fiancé (e) will apply for a K-1 nonimmigrant visa."

Not the first time nor will it be the last time an employee of the USCIS, DOS, SSA, IRS, TSA, etc will be incorrect. Government employees are not very well trained and most do not know their own rules and procedures.

Here is a question for you: If the K-1 is an immigrant visa, why did my then fiancee have to file a DS-156 and DS-156K form which is for non-immigrants?

There are a lot of bad answers in this thread. In response to me when I asked the OP's exact question some years ago, an immigration attorney (and a former consul) said: "The K-1 is a hybrid visa -- a nonimmigrant visa with immigrant intent. That's why it's always processed in the Immigrant Visa Units of the consulates."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes you are absolutely right, K1 is Immigrant type as you are going to marry and stay there as USA citizen.
